Rights and Duties, 5.OUR RIGHT TO RECOVER is deleted in its entirety and replaced with the following: 5.OUR RIGHT TO RECOVER In the event of any payment under this Insurance, we will be subrogated to all of your rights of recovery against any person or organization, and you agree to execute and deliver instruments and papers and do whatever else is necessary to secure such rights. You agree to do nothing before or after the payment of damages by us to prejudice such rights without our prior written consent. We will reimburse your retention from any amounts recovered in excess of damages and claim expenses we have paid. The foregoing does not apply to any person(s) or organization(s) whom you have agreed to waive your rights of recovery against in a written contract or agreement executed prior to the performance of your covered services or covered operations. Il. Solely with respect to the coverage provided by this Endorsement, the effective date stated in Section 3, of the Declarations is amended to 10/7/2024. III.
