3 Planning Commission <br />1 /27/2025 <br />*End of Consent Calendar* <br />BUSINESS CALENDAR <br />Public Hearing: The Planning Commission decision on Conditional Use Permits, <br />Variances, Tentative Tract and Parcel Maps, Minor Exceptions, Site Plan Review, and <br />Public Convenience or Necessity Determinations are final unless appealed within 10 <br />days of the decision by any interested party or group (refer to the Basic Meeting <br />Information page for more information). The Planning Commission recommendation <br />on Zoning and General Plan amendments, Development Agreements, Specific <br />Developments, and Specific Plans will be forwarded to the City Council for final <br />determination. Legal notice was published in the OC Reporter on January 15, 2025 <br />and notices were mailed on said date. <br />1. CONDITIONAL USE PERMIT NO. 2025-01 FOR THE <br />PROPERTY LOCATED AT 2600 SOUTH BRISTOL STREET <br />LOCATED WITHIN THE PLANNED SHOPPING CENTER (C4) <br />ZONING DISTRICT <br />Project Applicant: Matt Clark (Applicant) on behalf of Wendy's, representing <br />Bristol Palms Inc. (Property Owner) <br />Proposed Project: The applicant is requesting approval of Conditional Use <br />Permit (CUP) No. 2025-01 to allow after-hours operation of a new Wendy's eating <br />establishment, which is proposed to occupy an existing stand-alone commercial <br />pad building with a drive -through. Pursuant to the Santa Ana Municipal Code, <br />eating establishments open at any time between the hours of 12:00 a.m. and 5:00 <br />a.m., and located within 150 feet of residentially used or zoned properties, require <br />approval of a CUP. The Wendy's after-hours are proposed only for the drive - <br />through operations from Sunday through Thursday 6:00 a.m. to 1:00 a.m. and <br />Friday and Saturday from 6:00 a.m. to 1:30 a.m. Wendy's indoor dining area is <br />only proposed to be open from 6:00 a.m. to 10:00 p.m., seven -days a week. <br />Environmental Impact: Pursuant to the California Environmental Quality Act <br />(CEQA) and the CEQA Guidelines, the project is exempt from further review <br />pursuant to Class 1, Section 15301 (Existing Facilities) of the CEQA Guidelines. <br />Categorical Exemption ER No. 2024-106 will be filed for this project. <br />Recommended Action: <br />1. Adopt a resolution approving Conditional Use Permit No. 2025-01 as <br />conditioned. <br />Minutes: Chair Oliva recused herself due to living within the 1,000-foot buffer <br />map. <br />Commission had questions for staff. <br />Staff answered questions from staff. <br />Commission had questions for applicant. <br />Applicant, Matt Clarke, answered questions from the Commission. <br />
