R~SOLUTION 67-19 AFFIRMING THE DECISION OF <br />THE PLANNING COMMISSION AND GRANTING VARIANCE <br />ON VARIANCE APPLICATION 66-88 FILED BY GEORGE <br />ARGYROS AND LEE SCHULTZ <br /> <br /> WHEREAS, after public hearing on notice the Planning Com- <br />mission has granted a variance on variance application 66-88, <br />filed by George Argyros and Lee Schultz to construct and operate <br />a Tic-Toc Market and gasoline service station on property located <br />at the northwest corner of Newhope Street and Edinger Avenue in an <br />R-1 District; said variance was granted subject to certain condi- <br />tions, and <br /> <br /> WHEREAS, Appeal Application No. 187 was duly filed by the <br />Planning Department, appealing the decision of the Planning <br />Commission to grant said variance and requesting a hearing before <br />the City Council, and <br /> <br /> WHEREAS, the City Council, after public hearing on notice, <br />has determined that said variance should be granted subject to the <br />conditions imposed by the Planning Commission; <br /> <br /> NOW, THF~REFORE, BE IT RESOLVED: That the decision of the <br />Planning Commission to grant a variance on Variance Application <br />2095 to permit the construction and operation of a Tic Toc Market <br />and gasoline service station on property location at the northwest <br />corner of Newhope Street and Edinger Avenue in an R-1 District is <br />hereby affirmed subject to the following conditions imposed by the <br />Planning Co~unission: <br /> <br />1. That development be according to plot plan; except for minor <br />modifications approved by the Planning Department; <br /> <br />That a full landscape plan be submitted to and approved by the <br /> Planning Department; said landscaping plan to include the <br /> following: <br /> <br />a. that a brick or stone wall be placed to enclose each <br /> landscaped area to a minimum height of 6", <br /> <br />b. that landscaping for the planter areas be approved by <br /> the Planning Department, <br /> <br />c. that a complete sprinkler system be installed to irri- <br /> gate each planter area; <br /> <br />3. That all trash areas be enclosed by a 6' high concrete block <br /> wall; <br /> <br />4. That a 6' high masonry wall be constructed along property <br /> lines adjacent to single family homes; <br /> <br />5. That the large tree in the front yard of 1229 Karen Street <br /> be retained, so long as it is located in the landscape area; <br /> <br />That the proposed building be residentially designed so as to <br /> be compatible with surrounding residential development. <br /> Building elevations to be approved by the Director of Plan- <br /> ning, or the Planning Commission. The exterior surfacing of <br /> the service station shall be of a nonmetallic-appearing <br /> surface, Spanish style with a tile roof; <br /> <br />7. That all lights be shielded or oriented away from surrounding <br /> residences; <br /> <br /> <br />
