RESOLUTION 68-49 APPROVING MAP, DECLARING INTENTION
<br />TO VACATE THAT CERTAIN ALLEY LYING EASTERLY OF
<br />WESTERN AVENUE, BETWEEN SIXTH AND SEVENTH STREETS;
<br />RESERVING AN EASEMENT THEREIN FOR PACIFIC TELEPHONE
<br />COMPANY; AND GIVING NOTICE OF HEARING THEREON
<br />
<br /> WHEREAS, a request for the vacation of that certain alley lying
<br />easterly of Western Avenue, between Sixth and Seventh Streets, herein
<br />described, has been received by the City Council, and the Department
<br />of Public Works and the Planning Commission have recommended that a
<br />public hearing be set on the question of said vacation;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby
<br />approves the map attached hereto and orders the same filed with the
<br />original of this Resolution in the office of the Clerk of the Council,
<br />and reference is hereby made to said map for the exterior boundaries
<br />of said right of way proposed to be vacated.

<br /> The City Council declares its intention to proceed under the
<br />provisions of the Street Vacation Act of 1941 (Sections 8300 through
<br />8374 of the California Streets and Highways Code) to vacate that
<br />certain alley lying easterly of Western Avenue, between Sixth and
<br />Seventh Streets and RESERVING THEREIN an easement for utility structures
<br />for the Pacific Telephone Company. Said right of way proposed to be
<br />vacated lies in the City of Santa Ana, County of Orange, State of
<br />California, and is described as:

<br />That certain 15.75 foot wide alley in Chandlers Addition to
<br />Santa Ana, in the City of Santa Ana, County of Orange, State
<br />of California, as per map recorded in book 4, page 37 of
<br />Miscellaneous Maps, in the office of the County Recorder of
<br />said County, bounded easterly by the southerly prolongation
<br />of the east line of Lot 22 in said Chandlers Addition and
<br />westerly by the southerly prolongation of the westerly line
<br />of Lot 28 in said Chandlers Addition.

<br />RESERVING an easement and right of way, 5.00 feet in width,
<br />the center line of which is 8.00 feet northerly of the
<br />southerly line of said alley, to construct, place, operate,
<br />inspect, maintain, repair, replace, and remove such aerial
<br />and underground telephone, telegraph, and communication
<br />structures as the Pacific Telephone Company may, from time
<br />to time require, consisting of poles, anchors, wires, cables,
<br />conduits, manholes, markers, and necessary fixtures and
<br />appurtenances.

<br /> BE IT FURTHER RESOLVED: That May 6, 1968, at the hour of
<br />7:30 P.M. in the Council Chambers, City Hall, Third and Main Streets,
<br />Santa Ana, California, is hereby fixed as the time and place for
<br />hearing all persons interested in or objecting to said proposed street
<br />vacation.

<br /> BE IT FURTHER P~ESOLVED: That the Clerk of the Council of the
<br />City of Santa Ana is hereby ordered to publish this Resolution one
<br />time in the Register, and the Director of Public Works is ordered to
<br />post notices of street vacation conspicuously along the line of said
<br />street, stating the passage of this Resolution of Intention to vacate
<br />and the time and the place of hearing thereon. Said notices shall
<br />be posted not more than 300 feet apart and at least three (3) such
<br />notices shall be posted. Both publication and posting shall be
<br />
