No. 54-60 <br />denying application <br /> <br />Yn Re. <br />Variance <br />Howard Ryan <br /> <br />This being the date set for hearing protests on annexation to <br /> <br />City of certain uninhabited territory designated as "Delhi and Bristol <br />N.W.", no protests were received. On motion of Councilman Jerome, <br />sebonded by Dahl and carried, the following Ordinance entitled: <br /> <br /> "Ordinance spprovlng the annexation of that <br /> certain territory designated?~Delhi and <br /> Bristol N.Y.I'' <br /> <br />was introduced, considered and placed on file for second reading. <br /> # <br /> Communication was re~d from the P~anning Commission recommending <br /> of variance by. Resolution No;634 <br /> approval_/to permit erection of the First Evangelical United Brethren <br /> <br />Church on a five-acre parcel of property situated on the west side of <br />Santiago Avenue, between Buffalo and Avalon Streets, if extended west, <br />subject to certain conditions. Letters were read from various person~ <br />objecting to the erection of the Church. Attorney Fred D. Johnston, <br />on behalf of the Church, e~lained the reasons why the Church desired <br />to build on the property. Attorney ~alter Steiner, representing <br />approximately 200 persons who had signed a petition objecting ~the <br />variance, gave reasons why the variance should not be granted. <br /> <br />Snyder, 2205 Poinsettia Street, asked whether the improvements as <br />stipulated by the Planning Commission were to be borne by the Church <br />and how soon such improvements ~ould be made. Mr. Heiser, a member <br />of the Church Building Committee, stated that the improvements would <br />be made as soon as the property was purchased. Frank Pope, Realtor, <br />said property values would decrease in the i~mediate area, if the <br />variance was granted. Joe Moore, 2109 Valencia Street, stated thst <br />the street should be improved on both sides rather than on only one <br />side. Numerous persons objected to the additional noise and traffic <br />which would be created. The Chairman asked Mr. Heiser if the Ch'urch <br />had made any attempt to locate elsewhere. Mr. Heiser stated that the <br />had looked at several locations but this location was the most Eesirab <br />for their purpose. The Council having unanimously waived the:reading <br />of the Resolution, on motion of Councilman L~rsen, seconded by McBride <br />and carried, the following Resolution entitled: <br /> <br /> "Resolution No. 54-60 denying variance after the <br /> Planning Commission had recommended that same be <br /> granted" <br /> <br />was considered and passed by the following vote: <br /> <br /> Ayes, Councilmen William Jergme, J.L.McBride, <br /> Thomas F. Larsen, Milford ~. Dmhl, <br /> Courtney R. Chandler <br /> Noes, Councilmen None <br /> Absent, Councilmen None <br /> <br />Communication was read from the Planning Commission recommending approv <br />of variance application of Howard Ry~ to permit use of property at 802 <br />and 806 West 2nd Street, for off-street parking for employees <br />customers~ cars and storage for merchandise, subject.to certain <br />conditions. Attorney Lloyd Maines, representing various property <br />owners in the Im~:ediate hrea stated that the planning is conflicting <br />and that a si~Z~oot concrete block wall built on three sides cE the <br />property is 5et ~ sufficient safeguard; also, that the off-street park~ <br />lng area should be black-topped.
