RESOLUTION 70-38 AFFIRMING THE DECISION OF <br />THE PLANNING COMMISSION AND GRANTING A <br />VARIANCE ON VARIANCE APPLICATION 69-102, <br />SUBJECT TO CERTAIN APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission granted a variance on Variance Application 69-102, filed <br />by JOSEPH R. CALLENS, to permit the construction of a garden <br />apartment complex and a commercial building in the R-1 District at <br />3771 South Greenville Street, Santa Ana; and <br /> <br /> WHEREAS, the City Council on its own motion set the matter <br />for hearing; and <br /> <br /> WHEREAS, the City Council, after public hearing on notice <br />has determined that said Variance Application meets the requirements <br />of Section 41-638 of the Santa Ana Municipal Code and that said <br />Variance should be granted with the modification that there shall <br />be no commercial buildings or enterprises within said development <br />subject to certain applicable conditions: <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana does hereby affirm the decision of the <br />Planning commission and does hereby grant a variance on Variance <br />Application 69-102, filed by JOSEPH R. CALLENS, to permit the <br />construction of a garden apartment complex in the R-1 District. <br />The application to include within the garden apartment complex <br />buildings for commercial use is denied. Said Variance is granted <br />subject to the following conditions: <br /> <br />That a revised plot plan be submitted to the approved by <br /> the Planning Department indicating the following: <br /> (a) Fire Department approval of access to interior <br /> apartments; <br /> (b) location of trash areas; <br /> <br />o <br /> <br />That development be according to the approved revised <br /> plot plan except for minor modifications to be approved <br /> by the Planning Department, and except for the deletion <br /> of commercial structures. <br /> <br />o <br /> <br />That a detailed landscape plan be submitted to and approved <br /> by the Planning Department, and the approved plan be <br /> implemented and all landscaping be continuously <br /> maintained. <br /> <br />Trash and storage areas shall be screened from the apart- <br /> ments with a minimum 6-foot high opaque wall or fence <br /> and a solid gate with adequate access to and from <br /> these areas for collection vehicles. <br /> <br />5. That there is a minimum of 15 feet between main buildings <br /> clear of balconies, landings, or stairways. <br /> <br />6. That a floor plan for the proposed child day care center <br /> be submitted to and approved by the Planning Department; <br /> <br />7e <br /> <br />A concrete block wall 6 feet in height measured from the <br /> lowest finished grade on either side of the wall be <br /> constructed along the north and east property lines; <br /> <br />Be <br /> <br />Additional units may be added with the removal of the <br /> convenience center. Said additional units shall meet <br /> with the approval of the Planning Department. <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE <br />ISSUANCE OF A BUILDING PERMIT: <br /> <br />-1- <br /> <br /> <br />
