RESOLUTION 70-101 APPROVING MAP AND DECLARING INTENTION TO VACATE A PORTION OF McFADDEN AVENUE WEST OF VILLAGE P~XY WHEREAS, that portion of McFadden Avenue as it exists west of Village Way is no longer necessary for present or prospective street purposes, and the Department of Public Works and the Planning Commission of the City of Santa Ana have recommended that a public hearing be set on the question of vacating said right of way; NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby approves the map attached hereto and orders the same filed with the original of this Resolution in the office of the Clerk of the Council, and reference is hereby made to said map for the exterior boundaries of the right of way proposed to be vacated; BE IT FURTHER RESOLVED: That the City Council hereby declar~ its intention to proceed under the provisions of the Street Vacation Act of 1941 (Sections 8300 through 8374 of the California Streets and Highways Code) to vacate that portion of McFadden Avenue lying west of Village Way . Said right of way proposed to be vacated lies in the City of Santa Ana, County of Orange, State of California, and is described as follows: That portion of Parcel 1, in the City of Santa Ana, County of Orange, State of California, as per map filed in Book 27, Page 49 of Parcel Maps, in the office of the County Recorder of said County, described as follows: Beginning at an angle point in the Northerly line of said Parcel 1, said point being the Easterly terminus of that certain course in said Northerly line shown on said map as "North 88° 55' 45" East 287.68 feet"; said point also being a point in a line that is parallel with and distant Southerly 40.00 feet, measured at right angles, from the center line of McFadden Avenue, as shown on said map; thence North 88° 55' 45" East parallel with said center line of McFadden Avenue, a distance of 138.12 feet to the beginning of a tangent curve concave Southwesterly having a radius of 27.00 feet, said curve being tangent at its Southerly terminus to a line that is parallel with and distant Westerly 30.00 feet, measured at right angles, from the center line of Village Way, as shown on said map; thence Easterly and Southeasterly along said curve through a central angle of 53° 28' 33" an arc distance of 25.20 feet to the Easterly terminus of that certain course in the Northerly line of said Parcel 1, shown on said map as "North 87° 09' 25" West 160.19 feet"; thence North 87° 09' 25" West along said Northerly line of Parcel 1 a distance of 160.19 feet to the point of beginning. BE IT FURTHER RESOLVED: That December 7, 1970, at the hour of 7:30 P.M. in the Council Chambers, City Hall Annex, 500 West Sixth Street, Santa Ana, California, is hereby fixed as the time and place for hearing all persons interested in or objecting to said proposed street vacation; BE IT FURTHER RESOLVED: That the Clerk of the Council of the City of Santa Ana is hereby ordered to publish this Resolution one time in the Register, and the Director of Public Works is ordered -1-
