RESOLUTION 71-36 UPHOLDING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCE APPLICATION 71-1, FILED BY LES-SIM INC., <br />SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission granted a variance on Variance Application 71-1, filed <br />by LES-SIMS INC. to construct a retail package liquor mart in the <br />A-1 District at 2638 North Glassell Street, Santa Ana, California; <br />and <br /> <br /> WHEREAS, Appeal Application 262 was duly filed by the <br />applicant appealing the decision of the Planning Commission and <br />presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing, on notice, <br />has determined that the decision of the Planning Commission <br />should be upheld; that said Variance Application meets the require- <br />ments of Section 41-638 of the Santa Ana Municipal Code and that <br />said Variance should be granted subject to certain applicable <br />conditions; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council of <br />the City of Santa Ana does hereby affirm the decision of the <br />Planning Commission and does hereby grant a variance on Variance <br />Application 71-1, filed by LES-SIM INC. to permit the construction <br />of a retail package liquor mart in the A-1 District at 2638 North <br />Glassell Street, Santa Ana, California; said Variance is granted <br />subject to the following conditions: <br /> <br />1. That a revised plot plan be submitted to and approved by the <br /> Planning Department indicating: <br /> <br />the propQsed driveway having a maximum width of 28.6'. <br />(The design and the location of the driveway shall be <br />approved by the Public Works Department.) <br /> <br />NOTE: <br /> <br />City has vehicular access rights to Fairhaven Avenue <br />and Glassell Street except at existing drives. City <br />will quitclaim driveway location back to owner. <br /> <br />a five foot wide landscaped strip along Glassell from <br />the existing southerly driveway to the southerly property <br />line, except at the proposed driveway. <br /> <br />c. the elimination of the proposed pole sign at the southeast <br /> corner of the subject property. <br /> <br />d. nine (9) offstreet parking stalls that conform to the <br /> standards of the Ordinance. <br /> <br />Development shall be according to the approved revised plot <br />plan except for minor modifications approved by the Planning <br />Department. <br /> <br />3. That no wall signs on the southerly facade of the building <br /> or any roof signs shall be permitted. <br /> <br />e <br /> <br />That a landscaped plan for the planter strip be submitted to <br />and approved by the Planning Department, and that said land- <br />scaping be implemented and be continuously maintained. <br /> <br />-1- <br /> <br /> <br />
