RESOLUTION 71-39 UPHOLDING THE DECISION <br />OF THE PLANNING COMMISSION AND GRANTING <br />A VARIANCE ON VARIANCE APPLICATION 71-7 <br />FILED ~?F IRST ~WESTERN 'BAi~K~AS~D ~TRUST COMPANY, <br />SUBJECT TO APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after Public Hearing on notice the Planning <br />Commission granted a variance on Variance application 71-7 <br />filed by First Western Bank and Trust Company, to waive a <br />portion of the off-street parking requirements to allow an <br />automobile service station, tire and battery store and two <br />restaurants in a shopping center on the east side of Bristol <br />Street from Sunflower to MacArthur in the CR and A1 Districts <br />at 3751 South Bristol Street, Santa Ana, California; and <br /> <br /> WHEREAS, appeal application 264 was duly filed by the <br />applicant appealing condition 17 imposed by the Planning <br />Commission; and presenting the matter to the City Council; <br /> <br />and <br /> <br /> WHEREAS, appeal application 263 was duly filed by <br />Segerstrom Republic Homeowners, Inc. appealing decision of <br />the Planning Commission to eliminate sidewalks along Bristol <br />Street and presenting the matter to the City Council; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That based upon the <br />Findings of Fact of the Planning Commission the City Council <br />of the City of Santa Ana does hereby uphold the decision of <br />the Planning Commission, and appeals 263 and 264, filed by <br />Segerstrom Republic Homeowners, Inc. and First Western Bank <br />and Trust Company are hereby approved. <br /> <br /> BE IT FURTHER RESOLVED: That the City Council of the <br />City of Santa Ana does hereby uphold the decision of the <br />Planning Commission and does hereby grant a Variance on <br />Variance Application 71-7 filed by First Western Bank and <br />Trust Company to waive a portion of off-street parking, permit <br />two service stations, an automobile service facility, and two <br />restaurants in a shopping center in the CR District, and parking <br />in the A1 District at 3751 South Bristol Street; said Variance <br />is granted subject to the following conditions: <br /> <br />That development be according to the approved <br />plot plan except for minor modifications approved <br />by the Planning Department. <br /> <br />That a 6' high solid masonry wall (measured from <br />the highest finished grade) be constructed along <br />the easterly property line of Parcel I, except <br />along the 15' adjacent to MacArthur Boulevard <br />where the wall shall be reduced to 4' <br /> <br />3. That a landscape plan be submitted to and approved <br /> by the Planning Department indicating: <br /> <br />a) <br /> <br />A minimum five-foot wide landscaped planter <br />along all street frontages, except at approved <br />driveways. <br /> <br />b) 3% of the offstreet parking area be landscaped <br /> with trees, shrubs, and ground covers. <br /> <br />c) one-fifteen (15) gallon tree for each ten (10) <br /> offstreet parking spaces, or portion thereof. <br /> <br />Said landscaping shall be implemented according <br />to the landscape plan, be permanently maintained <br />and be provided with automatic irrigation devices. <br /> <br />- 1 - <br /> <br /> <br />
