RESOLUTION 71-57 OVERRULING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCE APPLICATION 71-17, SUBJECT TO CERTAIN <br />APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission denied a variance on Variance application 71-17 <br />filed by H & J MABURY COMPANY to construct two-story garden <br />apartment development in the R-4 District within 150 feet of <br />R-1 zoned property, to waive a portion of the required 50% <br />open space, and to permit off-street parking in the R-1 <br />District at 1851 East Fruit Street, Santa Ana, California; <br />and <br /> <br /> WHEREAS, Appeal Application 265 was duly filed by the <br />applicant, appealing the decision of the Planning Commission <br />and presenting the matter to the City Council; and <br /> <br /> WHEREAS, the City Council, after public hearing, on <br />notice, has determined that said Variance should be granted, <br />subject to certain applicable conditions; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council <br />of the City of Santa Ana does hereby overrule the decision of <br />the Planning Commission and does hereby grant a variance on <br />Variance Application 71-17, filed by H & J MABURY COMPAN~ to <br />permit the construction of a 2-story garden apartment development <br />in the R-4 District within 150 feet of R-1 zoned property,to <br />waive a portion of the required 50% open space and to permit <br />off-street parking in the R-1 District at 1851 East Fruit Street, <br />Santa Ana, California; said variance is granted subject to the <br />following conditions: <br /> <br />That the revised plot plan approved by the Council action <br /> be submitted to the Planning Department indicating all <br /> approved changes; and that the development be according <br /> to the approved revised plot plan except for minor <br /> modifications approved by the Planning Department; <br /> <br />2. That there be a minimum 15 feet between main dwellings, <br /> clear of balconies, landings or stairways; <br /> <br />That a landscape plan be submitted to and approved by the <br /> Planning Department; and that said landscaping be <br /> implemented and be continuously maintained. <br /> <br />4. That the trash areas be enclosed in accordance with the <br /> Planning Department standards; <br /> <br />THE FOLLOWING CONDITIONS ARE TO BE COMPLIED WITH PRIOR TO THE I <br />ISSUANCE OF A BUILDING PERMIT: <br /> <br />5. File and record a parcel map with the City of Santa Ana and <br /> comply with all conditions of Council approval; <br /> <br />e <br /> <br />Furnish to the Department of Public Works the following: <br /> a. A runoff study by a civil engineer based on a storm <br /> of a ten-year frequency. Show existing and proposed <br /> facilities and methods of draining this area and <br /> tributary areas without exceeding the capacity of any <br /> street, on-site or off-site. <br /> <br />-1- <br /> <br /> <br />
