RESOLUTION 71-100 APPROVING MAP AND DECLARING <br />INTENTION TO VACATE ALLEY ON NORTH SIDE OF <br />CIVIC CENTER DRIVE BETWEEN ROSS STREET AND <br />VAN NESS AVENUE; RESERVING AN EASEMENT THERE- <br />IN FOR PACIFIC TELEPHONE COMPANY AND GIVING <br />NOTICE OF HEARING THEREON <br /> <br /> W~EREAS, the Department of Public Works and Planning Commis- <br />sion have recommended a public hearing be set on the question of <br />said vacation, a request for the vacation of that certain alley <br />on the north side of civic Center Drive between Ross Street and <br />Van Ness Avenue, herein described, has been received by the City <br />Council. <br /> <br /> W~EREAS, the Orange County Employees Association has received <br />a variance to erect an eight story office building and the abandon- <br />ment of said alley was conditioned on the improvement and dedication <br />of a 20' east/west alley between Ross Street and Van Ness Avenue <br />located at the northern portion of the proposed abandoned alley. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby <br />approves the map attached hereto and orders the same filed with <br />the original of this Resolution in the office of the Clerk of the <br />Council, and reference is hereby made to said map for the exterior <br />boundaries of said right of way proposed to be vacated. <br /> <br /> The City Council declares its intention to proceed under the <br />provisions of the Street Vacation Act of 1941 (Section 8300 through <br />8374 of the California Streets and Highway Code) to vacate that <br />certain alley lying northerly on civic Center Drive, between Ross <br />Street and Van Ness Avenue, and RESERVING THEREIN an easement for <br />utility structures for the Pacific Telephone Company. Said right <br />of way proposed to be vacated lies in the City of Santa Ana, County <br />of Orange, State of California, and is described as: <br /> <br />Ail that portion of an 18 foot alley as shown on a <br />map of Townsend Tract in the city of Santa Ana re- <br />corded in Book 4, Page 30 of Miscellaneous Maps, <br />records of Orange County, California bounded Nor- <br />therly by a line parallel with a distant 20.00 feet <br />Southerly, measured at right angles, from the North <br />line of said Townsend Tract also being the North <br />line and the Easterly prolongation of the North line <br />of Lot 11 of said Townsend tract and bounded Southerly <br />by a line parallel with and distant 30.00 feet Northerly, <br />measured at right angles from the center line of Hickey <br />Street, now called Civic Center Drive West. <br /> <br />Reserving an easement over the easterly 6.00 feet of <br />the above described 18 foot alley to construct, place <br />operate, inspect, maintain, repair, replace and remove <br />such aerial and underground telphone, telegraph and <br />communication structures as the company may from time <br />to time require, consisting of poles, anchors, wires, <br />cables, conduits, manholes, markers and necessary fix- <br />tures and appurtenances. <br /> <br />Also reserving all vehicular access rights to Civic <br />Center Drive West from the lands lying Northerly of <br />the Southerly line of the above described 18 foot al- <br />ley. <br /> <br />- 1 - <br /> <br /> <br />
