RESOLUTION 71-106 ORDERING THE VACATION OF ALLEY ON NORTH SIDE OF CIVIC CENTER DRIVE BETWEEN ROSS STREET AND VAN NESS AVENUE; RESERVING AN EASEMENT THEREIN FOR PACIFIC TELEPHONE COMPANY WHEREAS, on recon~uendation of the Department of Public Works and the Planning Commission of the City of Santa Ana, Resolution 71-100 was adopted giving notice of intention to vacate alley on north side of Civic Center Drive between Ross Street and Van Ness Avenue, and RESERVING THEREIN an easement for Pacific Telephone Company. WHEREAS, on November 15, 1971, a public hearing was duly held on said vacation of alley on posted notices and the publication of said Resolution 71-100. NOW, THEREFORE, BE IT RESOLVED: That the City Council of the City of Santa Ana hereby finds that above mentioned alley is unnecessary for present or prospective street purposes and does hereby make its order abandoning and vacating said alley and RESERVING THEREIN an easement for Pacific Telephone Company. Said right of way lies in the City of Santa Ana, County of Orange, State of California, and is described as: Ail that portion of an 18 foot alley as shown on a map of Townsend Tract in the City of Santa Ana recorded in Book 4, Page 30 of Miscellaneous Maps, records of Orange County, California bounded Northerly by a line parallel with and distant 20.00 feet Southerly, measured at right angles, from the North line of said Townsend Tract also being the North line and the Easterly pro- longation of the North Line of Lot 11 of said Townsend Tract and bounded Southerly by a line parallel with and distant 30.00 feet Northerly, measured at right angles from the center line of Hickey Street, now called Civic Center Drive West. Reserving an easement over the Easterly 6.00 feet of the above described 18 foot alley to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication structures as the company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances. Also reserving all vehicular access rights to Civic Center Drive West from the lands lying Northerly of the Southerly line of the above described 18 foot alley.
