RESOLUTION NO. 72-67 <br /> <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA DENYING ~.PPEAL #296 FILED BY <br />SANDPOINTE HOMEOWNERS' ASSOCIATION AND UP- <br />HOLDING THE DECISION OF THE PLANNING COM- <br />MISSION GRANTING VARIANCE APPLICATION 72-10 <br />FILED BY ROBERT H. GRANT CORPORATION <br /> <br /> BE IT RESOLVED: That, based upon the Findings of Fact of the <br />Planning Commission presented before the City Council, the City <br />Council of the City of Santa Ana hereby denies Appeal #296 filed by <br />Sandpointe Homeowners' Association and upholds the decision of the <br />Planning commission granting VA 72-10 filed by Robert H. Grant <br />Corporation to allow a small commercial development facing MacArthur <br />Blvd. and 42 town house units facing Main Street in the C 4 District, <br />subject to the following conditions: <br /> <br />That development be according to the approved plot plan, <br />revised as follows, except for minor modifications approved <br />by the Planning Department. <br /> <br />1 (a)The plot plan shall be revised to provide for the following <br /> numbered bedroom units: <br /> <br />10 - 2 bedroom units with 914 square feet. <br />COrdinance requires 800 square feet~ <br />20 - 2 bedroom units with 984 square feet. <br />(Ordinance required 800 square feet~. <br />10 3 bedroom units with 1,453 square feet. <br />(Ordinance required 900 square feet). <br />2 - 2 bedroom units with 800 square feet. <br />(Ordinance requires 800 square feet)· <br /> <br />l(b) There shall be 126 offstreet parking spaces of which 42 are <br /> covered and 84 are open. (Ordinance required a total of 63). <br /> <br />That all conditions of the Building and Fire Departments <br />be met. <br /> <br />e <br /> <br />That a landscape plan be submitted to and approved by the <br />Planning Department, including the provisions of Sec. 41-618 <br />of the Zoning Ordinance, and that said landscaping be <br />implemented and be continuously maintained. <br /> <br />That any trash areas be enclosed in accordance with the <br />Planning Department standards. <br /> <br />That there be a minimum 15 feet between main dwellings, <br />clear of balconies, landings or stairways. <br /> <br />Submit to the Department of Public Works, for their approval, <br />an acceptable final grading plan or an on-site drainage plan <br />or both, showing the direction and means of flow to the <br />adjacent street(s] or channel(s) when this property is <br />developed. Plan is to include existing and proposed eleva- <br />tions at the property lines. Applicants should check with <br />the Department of Public Works for extent of study needs. <br /> <br />e <br /> <br />Submit a sanitary sewer study to the Department of Public <br />Works. <br /> <br />8. Dedicate vehicular access rights. <br /> <br />Provide construction plans for: <br />a. required street improvement, <br />b. sewer system <br /> <br /> <br />
