RESOLUTION NO. 72-107 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA FINDING THAT <br />CERTAIN MODIFICATION AND CHANGES IN <br />THE REGULATIONS CONTAINED IN THE UNI- <br />FORM BUILDING CODES AND THE UNIFORM <br />PLUMBING CODE, 1970 EDITIONS, ARE <br />REASONABLY NECESSARY BECAUSE OF LOCAL <br />CONDITIONS <br /> <br /> WHEREAS, the City Council of the City ofSanta Aha will <br />consider the adoption of proposed Ordinance NS-1147 , which <br />would adopt by reference into the Santa Ana Municipal Code <br />the 1970 Editions of the Uniform Building Code, including <br />Volume 1, the "Standards" Voltune, Volume II, "Uniform Mech- <br />anical Code" and Volume III, "Housing," and the Uniform <br />Plumbing Code; and <br /> <br /> WHEREAS, said proposed Ordinance NS-1147 includes certain <br />modifications and changes in the regulations contained in said <br />uniform codes; and <br /> <br /> WHEREAS, Section 17958.7 of the California Health and <br />Safety Code requires that a governing body before making any <br />such modifications or changes shall make an express finding <br />that such modifications or changes are needed, <br /> <br /> NOW THEREFORE BE IT RESOLVED, the City Council finds that <br />the modifications and changes in the regulations contained in <br />said Uniform Codes, as such modifications and changes are set <br />forth in proposed Ordinance NS-l147 are reasonably necessary <br />because of local conditions. <br /> <br /> BE IT FURTHER RESOLVED that a copy of this resolution <br />shall be filed with the City Clerk and available as a public <br />record. <br /> <br /> BE IT FURTHER RESOLVED that the City Council finds that <br />said changes are necessary for the following reasons: <br /> <br />A. UNIFORM BUILDING CODE, Volume I, 1970 EDITION <br /> <br />1. Sections 8-100, 8-101, 8-102, 8-109, 8-110, and 8-111 are <br />administrative amendments which provide for fees and refunds <br />which are commensurate with the services provided by the B~ilding <br />Department and designed to produce revenues for services per- <br />formed. <br /> <br />2. Section 8-112 amends the use and occupancy provisions in <br />order to insure compliance with all other applicable City ordi- <br />nances and laws related to construction. <br /> <br />3. Section 8-156 adds requirements for fencing of swimming <br />pools, etc., in order to reduce the potential hazards to small <br />children. <br /> <br />4. Section 8-200 incorporates into the 1970 Edition modifica- <br />tions which have already been approved for the 1973 Edition of <br />the Uniform Building Code. The modifications reduce the limi- <br />tations upon the enclosing of patio covers. <br /> <br /> <br />
