RESOLUTION NO. 73-31 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA OVERRULING THE DECISION <br />OF THE PLANNING COMMISSION AND GRANTING <br />APPEAL NO. 316 ON VARIANCE APPLICATION 73-3 <br />FILED BY RAY MADRID <br /> <br /> BE IT RESOLVED: That based on the Findings of Fact <br />of the Planning Commission, the City Council of the City <br />of Santa Ana does hereby overrule the decision of the <br />Planning Commission and Grants Appeal No. 316 on Variance <br />Application No. 73-3 to construct a 16 unit apartment complex <br />in the R 1 District subject to the following conditions: <br /> <br />10. <br /> <br />11. <br /> <br />That all conditions of the Building Department <br />be met. <br /> <br />That a landscape plan be submitted to and <br />approved by the Planning Department, including <br />the provisions of Sec. 41-618 of the Zoning <br />Ordinance (prior to issuance of a building <br />permit) and that said landscaping be implemented <br />(prior to utility release) and be continuously <br />maintained. <br /> <br />That any trash areas be enclosed in accordance <br />with the Planning Department standards. <br /> <br />That there be a minimum 15 feet between main <br />dwellings, clear of balconies, landings or <br />stairways. <br /> <br />That there be no after-hours operation (between <br />2:00 A.M. and 6:00 A.M.). <br /> <br />That a screening plan for mechanical equipment or <br />appurtenances be submitted to and approved by <br />the Planning Department. <br /> <br />That all conditions of the Fire Department be met. <br /> <br />Submit to the Department of Public Works, for their <br />approval, an acceptable final grading plan or an <br />on-site drainage plan, or both, showing the direc- <br />tion and means of flow to the adjacent street(s) <br />or channel(s) when this property is developed. <br />Plan is to include existing and proposed elevations <br />at the property lines. Applicants should check <br />with the Department of Public Works for extent of <br />study needs. <br /> <br />Dedicate required street or alley right of way. <br /> <br />Dedicate vehicular access rights. <br /> <br />Provide construction plans for required street <br />improvement. <br /> <br />12. Pay drainage assessment fee. <br /> <br />-1- <br /> <br /> <br />
