RESOLUTION NO. 73-127 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA OVERRULING THE DECISION OF PLANNING <br />COMMISSION AND GRANTING APPEAL NO. 323 ON CONDI- <br />TIONAL USE PERMIT NO. 73-13 FILED BY THE HARLEQUIN <br />DINNER PLAYHOUSE <br /> <br /> BE IT RESOLVED: That, based upon "Findings of Fact" of <br />the Planning Commission and testimony presented before the <br />City Council, the City Council of the City of Santa Ana hereby <br />overrules the decision of the Planning Commission and grants <br />Appeal #323 on Conditional Use Permit No. 73-13 filed by the <br />Harlequin Dinner Playhouse to convert an existing warehouse <br />to a combination restaurant and commercial theatre in the M 1 <br />District subject to the following conditions: <br /> <br />1. That the "CUP" is approved for a ten year period. <br /> <br />2. That the "CUP is subject to annual review. <br /> <br />e <br /> <br />That development be according to the approved plot <br />plan, except for minor modifications approved by <br />the Planning Department. <br /> <br />4. That all conditions of the Building Department be met. <br /> <br />That a landscape plan be submitted to and approved by <br />the Planning Department, including the provisions of <br />Sec. 41-618 of the Zoning Ordinance (prior to issuance <br />of a building permit) and that said landscaping be <br />implemented (prior to utility release) and be con- <br />tinuously maintained. <br /> <br />6. That any trash areas be enclosed in accordance with <br /> the Planning Department standards. <br /> <br />That a screening plan for mechanical equipment or <br />appurtenances be submitted to and approved by the <br />Planning Department. <br /> <br />8. That all conditions of the Fire Department be met. <br /> <br />9. Pay street tree charges. <br /> <br />10. The following requirements must also be met: <br /> <br />ae <br /> <br />One free standing or pole sign shall be permitted <br />on Juniper Avenue in front of the theatre build- <br />ing. Said sign shall not approach within 10' of <br />the property on Juniper Avenue and shall not be <br />blinking, flashing, or rotating. The free stand- <br />ing pole sign shall meet with the approval of the <br />Planning Department and the Sign Ordinance except <br />where herein modified. <br /> <br />Lounge shall not be operated as a separate enter- <br />tainment area when performances are being held in <br />the main theatre. <br /> <br />One sign shall be permitted on the exterior of the <br />theatre building and shall be attached to the wall. <br />Said sign shall not exceed the height of the ex- <br />terior wall of the building and shall meet with <br /> <br /> <br />
