RESOLUTION NO. 73-146 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA REPEALING RESOLUTION NO. 73-140 <br />AND APPROVING MAP AND DECLARING INTENTION TO <br />ABANDON ALLEY LOCATED NORTH OF FRUIT STREET <br />BETWEEN FRUIT STREET AND SANTA ANA BOULEVARD <br />APPROXIMATELY 125 FEET WEST OF LINCOLN AVENUE <br /> <br /> WHEREAS, the Department of Public Works and the Planning <br />Commission have recommended a public hearing be set on the <br />question of said abandonment, a request for the abandonment of <br />an alley located north of Fruit Street between Fruit Street <br />and Santa Ana Boulevard approximately 125 feet west of Lincoln <br />Avenue has been received by the City Council. <br /> <br /> WHEREAS, the City Council has previously adopted Resolution <br />No. 73-140 approving map and declaring intention to abandon <br />alley located north of Fruit Street between Fruit Street and <br />Santa Ana Boulevard approximately 125 feet west of Lincoln <br />Avenue; and <br /> <br /> WHEREAS, the Department of Public Works has deemed it essen- <br />tial to the health, safety and welfare that vehicular access <br />rights across the northerly line of the above described property <br />be retained by theCity of Santa Ana. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That Resolution No. 73-140 <br />is hereby repealed. <br /> <br /> BE IT FURTHER RESOLVED: That the City Council hereby <br />approves the map attached hereto and orders the same filed with <br />the original of this Resolution in the Office of the Clerk of <br />the Council, and reference is hereby made to said map for the <br />exterior boundaries for said right of way proposed to be <br />abandoned. <br /> <br /> The City Council declares its intention to proceed under <br />the provisions of the Street Vacation Act of 1941 (Section <br />8300 - 8374 of the California Streets and Highways Code) to <br />abandon that alley located north of Fruit Street between Fruit <br />Street and Santa Ana Boulevard approximately 125 feet west of <br />Lincoln Avenue, in the City of Santa Ana, County of Orange, <br />State of California, described as follows: <br /> <br />That portion of the alley in Block "E" <br />of Hawkins Addition, in the City of <br />Santa Ana, County of Orange, State of <br />California, as per map recorded in book <br />13 page 26 of Miscellaneous Records, in <br />the office of the County Recorder of Los <br />Angeles County, California, bounded <br />Northerly by a line parallel with and <br />distant 52.00 feet Southeasterly, mea- <br />sured at right angles, from a line <br />described as having a bearing and dis- <br />tance of South 64° 18" 01" West 1421.66 <br />feet in a deed to the City of Santa Ana, <br />recorded December 17, 1968, in Book 8818 <br />page 197 of Official Records and bounded <br />Southerly by the Westerly prolongation of <br />the Southerly line of Lot 17 of said <br />Block "E". <br /> <br /> <br />
