'~4-4 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA ORDERING THE VACATION OF THE <br />ALLEY LOCATED NORTH OF FRUIT STREET BETWEEN <br />FRUIT STREET AND SANTA ANA BOULEVARD APPROXI- <br />MATELY 125 FEET WEST OF LINCOLN AVENUE <br /> <br /> W~EREAS, on recommendation of the Department of Public <br />Works and the Planning Commission of the City of Santa Ana, <br />the City Council of the City of Santa Ana adopted Resolution <br />No. 73-146, giving notice of intention to vacate the alley <br />located north of Fruit Street between Fruit Street and Santa <br />Ana Boulevard approximately 125 feet west of Lincoln Avenue; <br />and <br /> <br /> WHEREAS, Resolution no. 73-146 was published and notice <br />of intention to vacate was posted as required by law; and <br /> <br /> W~EREAS, on January 7, 1974, a public hearing was duly <br />held on said vacation; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council <br />of the City of Santa Ana hereby finds that the above named <br />alley is no longer necessary for present or prospective street <br />purposes, and does hereby make its order to vacate said right <br />of way. Said right of way lies in the City of Santa Ana, <br />County of Orange, State of California described as follows: <br /> <br />That portion of the alley in Block "E" <br />of Hawkins Addition, in the City of <br />Santa Ana, County of Orange, State of <br />California, as per map recorded in book <br />13 page 26 of Miscellaneous Records, in <br />the office of the County Recorder of Los <br />Angeles, County, California, bounded <br />Northerly by a line parallel with and <br />distant 52.00 feet Southeasterly, mea- <br />sured at right angles from a line <br />described as having a bearing and dis- <br />tance of South 64° 18' 01" West 1421.66 <br />feet in a deed to the City of Santa Ana, <br />recorded December 17, 1968, in Book 8818 <br />page 197 of Official Records and bounded <br />Southerly by the Westerly prolongation of <br />the Southerly line of Lot 17 of said <br />Block "E". <br /> <br />EXCEPTING THEREFROM an exclusive permanent <br />easement for vehicular access across the <br />northerly line of above described property <br />reserved by the City of Santa Ana. <br /> <br /> BE IT FURTHER RESOLVED: That the public convenience <br />and necessity require the reservation of an exclusive per- <br />manent easement for vehicular access across the northerly <br />line of above described property by the City of Santa Ana. <br /> <br /> <br />
