RESOLUTION NO. 74-5 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AMENDING RESOLUTION NO. 73-147 <br />EMPOWERING THE CITY MANAGER TO AUTHORIZE THE <br />CITY TO ENTER INTO CONTRACTS IN WRITING WITHOUT <br />ADVERTISING AND WITHOUT PREVIOUS APPROVAL BY <br />THE CITY COUNCIL FOR EACH SPECIFIC ITEM FOR THE <br />PAYMENT OF CHARGES OF SUPPLIES, LABOR OR OTHER <br />MATTERS. <br /> <br /> WHEREAS, Section 421 of the Santa Ana Municipal Charter <br />provides that the City Council may authorize any officer of <br />the City to bind the City on contracts in writing without <br />advertising and without previous approval by the City Council <br />of each specific item for the payment of charges for supplies, <br />labor, or other valuable consideration furnished to the City, <br />in amounts not exceeding Two Hundred Dollars ($200) in any <br />one contract; and <br /> <br /> WHEREAS, aforementioned Section 421 additionally provides <br />that the City Council may authorize the City Manager to bind <br />the City on contracts in writing without advertising and with- <br />out previous approval of the City Council for each specific <br />item for the payment of charges for supplies, labor, or other <br />valuable consideration to be furnished the city, in amounts <br />not exceeding two thousand dollars ($2,000.00) in any one con- <br />tract; and <br /> <br /> WHEREAS, in administering various city governmental func- <br />tions items must be purchased in the day to day operation of <br />the City most of which items involve relatively sma%! amounts <br />of money; and <br /> <br /> WHEREAS, the purchase of many of these numerous items <br />cannot wait for individual approval by the City Council; and <br /> <br /> WHEREAS, the volume of important matters which City Council <br />hears is so great that the Council's time could more usefully <br />and expeditiously be spent on other matters; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That Resolution No. 73- <br />147 is amended to be in conformance with this Resolution. <br /> <br /> BE IT FURTHER RESOLVED: That the City Council <br />chooses to exercise the power provided in Section 421 of the <br />Santa Ana Municipal Charter and hereby authorizes any officer <br />of the city to bind the city on contracts in writing without <br />advertising and without previous approval Of this Council of <br />each specific item for the payment of charges for supplies, <br />labor, or other valuable consideration furnished the city, <br />in amounts not exceeding Two Hundred Dollars ($200.00) in any <br />one contract. <br /> <br /> BE IT FURTHER RESOLVED: That any contract which any <br />city officer has entered into either personally or through <br />an authroized agent for the purpose of obtaining fuel during <br />the present fuel crisis is hereby expressly ratified provided <br />said contract is in an amount not exceeding Two Hundred <br />Dollars ($200.00). <br /> <br /> <br />
