The Environmental Impact <br /> Evaluator shall determine first, whether any given <br /> proposal constitutes a "project" as defined in these <br /> rules and regulations. <br /> <br /> (a) Emergenc~ Project Exception: The following emer- <br /> gency projects are exempt from the requirements <br /> for environmental impact repoKts: <br /> <br /> (1) Projqcts undertaken, carried out, or <br /> approved by the City of Santa Ana to main- <br /> tain, repair, restore~ demolish or replace <br /> property or facilities damaged or destroyed <br /> as a result of a disaster in a disaster- <br /> stricken area in which a state of emergency <br /> has been proclaimed by the Governor pursuant <br /> to Chapter 7 (commencing with Section 8550) <br /> of Division l, Title 2 of the Government Code. <br /> (2) Emergency repairs to public service facilities <br /> necessary to maintain service. <br /> <br /> (3) Projects undertaken as immediate action <br /> <br /> , necessary to prevent or m~[igate an emergency. <br />De~ermi. pation of ~inisterial or Discretiona?~. The <br />E~vironmenta~ Impact Evaldator shall de'termine whether <br />or not the~roject requires "ministerial" or "discre- <br />tionary'' action by the Ci'ty of Santa Aha.
