RESOLUTION NO. 74-53 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AUTHORIZING CONDEMNATION OF REAL <br />PROPERTY IN ORDER TO WIDEN SEVENTEENTH STREET, <br />AND AMENDING RESOLUTION 74-36 PASSED BY THE CITY <br />COUNCIL ON MARCH 11, 1974. <br /> <br /> BE IT RESOLVED: That the City Council of the City of <br />Santa Ana does hereby find and declare that the public interest <br />and necessity require that in order to widen Seventeenth Street, <br />the hereinbelow described real property be condemned. <br /> <br /> BE IT FURTHER RESOLVED: That work is to begin immediately, <br />and it is necessary for the City of Santa Ana to have possession <br />of the hereinbelow described property as soon as possible. <br /> <br /> BE IT FURTHER RESOLVED: That such acquisition is done in <br />a manner consistent with the greatest public good and the least <br />private injury. <br /> <br /> BE IT FURTHER RESOLVED: That the attached map be entered <br />as Exhibit "A" and be used as an illustration of the hereinbelow <br />described property: <br /> <br />Ail those portions of the Southeast quarter of <br />the Southeast quarter of the Southeast quarter <br />of Section 1, Township 5 South, Range 10 West, <br />San Bernardino Base and Meridian described as <br />follows: <br /> <br />The Southerly 52.00 feet of the Easterly 191.00 <br />feet of the Southeast quarter of the Southeast <br />quarter of the Southeast quarter of said Section <br />1 along with a spandrel shaped parcel of land <br />over that portion of the Southeast quarter of <br />the Southeast quarter of the Southeast quarter <br />of said Section 1 bounded Easterly by a line <br />parallel with and distant 45.00 feet Westerly, <br />measured at right angles, from the Easterly line <br />of said Section 1, bounded Southerly by a line <br />parallel with and distant 52.00 feet Northerly, <br />measured at right angles, from the South line of <br />said Section 1 and bounded North westerly by the <br />arc of a curve concave Northwesterly having a <br />radius of 25.00 feet and being tangent to said Easterly <br />and Southerly boundary. <br /> <br />Excepting therefrom those portions previously de- <br />dicated for street purposes. <br /> <br />Together with the right and easement to enter upon <br />the remaining portion of said lands of the owner <br />for purpose of severing and removing the portions <br />of any building on said parcel which lies partly <br />within and partly without the above described par- <br />cel of land and for the purposes of constructing <br />and maintaining any shoring, braces, foundations <br />or walls necessary to support the remaining improve- <br />ments on said remaining portion of said lands after <br />severing and removing therefrom said portion of build- <br />ing at any time within 120 days after the date posses- <br />sion is authorized as indicated in the Order for <br />Possession, or within 120 days after Final Judgment <br />in Condemnation, for the above enumerated purposes. <br /> <br /> BE IT FURTHER RESOLVED: That this Resolution amends <br />Resolution 74-36 passed by the City Council of the City of Santa <br />Ana March 11, 1974. <br /> <br /> <br />
