RESOLUTION NO. 74-137 <br /> <br />A ~ESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APPROVING MAP AND DECLARING <br />INTENTION TO VACATE A PORTION OF AN ALLEY <br />LOCATED BETWEEN MAIN AND BUSH STREETS, SOUTH <br />OF TWELFTH STREET, AND RESERVING AN EASEMENT <br />FOR UTILITY PURPOSES <br /> <br /> WHEREAS, the Department of Public Works and the Planning <br />Commission have recommended a public hearing be set on the <br />question of said abandonment, a request for the abandonment <br />of a portion of an alley located between Main and Bush Streets, <br />south of Twelfth Street; and <br /> <br /> WHEREAS, the Department of Public Works has deemed it <br />essential to the health, safety and welfare that an easement <br />be retained over said right of way for the Pacific Telephone <br />and Telegraph Company for utility purposes. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City of Santa <br />Ana hereby approves the map attached hereto and orders the same <br />filed with the original of this resolution in the office of the <br />Clerk of the Council, and reference is hereby made to said map <br />for the exterior boundaries for said right of way proposed to <br />be abandoned. <br /> <br /> The City Council declares its intention to proceed under <br />the provisions of the Street Vacation Act of 1941 (§§8300-8374 <br />of the California Streets and Highways Code) to abandon a portion <br />of an alley located between Main and Bush Streets, south of Twelfth <br />Street in the City of Santa Ana, County of Orange, State of <br />California, described as follows: <br /> <br />Ail of the 12 foot alley as set forth <br />in "Smith and Bishops Addition to Santa <br />Aha" recorded in Book 13, Page 63, <br />Miscellaneous Records of Los Angeles <br />County, California, bounded on the East <br />by the West line of Bush Street 50 feet <br />wide. Except the West 12 feet in Main <br />Street. <br /> <br />Reserving an easement for Pacific <br />Telephone and Telegraph Company to con- <br />struct, place, operate, inspect, maintain, <br />repair, replace and remove such aerial <br />and underground telephone, telegraph and <br />communication structures as the Company <br />may from time to time require, consisting <br />of poles, anchors, wires, cables, conduits, <br />manholes,markers and necessary fixtures <br />and appurtenances. <br /> <br /> BE IT FURTHER RESOLVED that the public convenience and <br />necessity require the reservation of an exclusive permanent <br />easement over a portion of said alley by the Pacific Telephone <br />and Telegraph Company for utility purposes. <br /> <br /> <br />
