RESOLUTION NO. 74-153 <br /> <br />Recorded 10/16/74, 9'.'05 AM <br />Book 11265 Page 1708 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA ORDERING THE VACATION <br />OF A PORTION OF AN ALLEY LOCATED BETWEEN <br />MAIN AND BUSH STREETS, SOUTH OF TWELFTH <br />STREET, AND RESERVING AN EASEMENT FOR <br />UTILITY PURPOSES <br /> <br /> WHEREAS, on recommendation of the Department of Public <br />Works and the Planning Commission of the City of Santa Ana, <br />Resolution No. 74-137 was adopted giving notice of intention <br />to vacate a portion of an alley located between Main and Bush <br />Streets, south of Twelfth Street; and <br /> <br /> WHEREAS, Resolution No. 74-137 was published and notice <br />of intention to vacate was posted as required by law; and <br /> <br /> WHEREAS, on October 7, 1974, a public hearing was duly <br />held on said vacation; and <br /> <br /> WHEREAS, the Department of Public Works has deemed it <br />essential to the health, safety, and welfare that an easement <br />be retained over said right of way for the Pacific Telephone <br />and Telegraph Company for utility purposes. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />the City of Santa Ana hereby finds that the abovementioned <br />street is unnecessary for present or prospective street pur- <br />poses and does hereby make its order abandoning and vacating <br />for street purposes that certain right of way located in the <br />City of Santa Ana, County of Orange, State of California, <br />described as follows: <br /> <br />Ail of the 12 foot alley as set forth <br />in "Smith and Bishops Addition to Santa <br />Ana" recorded in Book 13, Page 63, <br />Miscellaneous Records of Los Angeles <br />County, California, bounded on the East <br />by the West line of Bush Street 50 feet <br />wide. Except the West 12 feet in Main <br />Street. <br /> <br />~serving an easement for Pacific <br />Telephone and Telegraph Company to con- <br />struct, place, operate, inspect, maintain, <br />repair, replace and remove such aerial <br />and underground telephone, telegraph and <br />co~tuL~unication structures as the Company <br />may from time to time require, consisting <br />of poles, anchors, wires, cables, conduits, <br />manholes, markers and necessary fixtures <br />and appurtenances. <br /> <br /> BE IT FURTHER RESOLVED that the public convenience and <br />necessity require the reservaion of an exclusive permanent <br />easement over a portion of said alley by the Pacific Telephone <br />and Telegraph Com%pany for Utility purposes. <br /> <br /> <br />
