RESOLUTION 7~4-179 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA UPHOLDING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING VARIANCENO. <br />74-30 FILED BY CALVARY EVANGELICAL LUTHERAN <br />CHURCH. <br /> <br /> BE IT RESOLVED: That based upon the Findings of Fact <br />of the Planning Commission, and the evidence presented at a <br />public hearing held November 18, 1974, the City Council of <br />the City of Santa Ana does hereby grant Variance No. 74-30 <br />filed by Clavary Evangelical Lutheran Church, northwest cor- <br />ner of Euclid and McFadden Streets, Santa Ana, California, <br />to construct a private tennis club in the R 1 zone, and to <br />allow an on-sale liquor license within 300' of property zoned <br />and used for residential, subject to the following conditions: <br /> <br /> 1. That development be according to the approved plot <br />plan, except for minor modifications approved by the Planning <br />Department. <br /> <br />2. That all conditions of the Building Department be met. <br /> <br /> 3. That a landscape plan be submitted to and approved by <br />the Planning Department, including the provisions of Sec. 41- <br />618 of the Zoning Ordinance (prior to issuance of a building <br />permit) and that said landscaping be implemented (prior to <br />utility release) and be continuously maintained. <br /> <br /> 4. That any trash areas be enclosed in accordance with <br />the Planning Department standards. <br /> <br /> 5. That there be no after-hours operation (between 2:00 <br />A.M. and 6:00 A.M.). <br /> <br /> 6. That the business remain a bona fide eating establish- <br />ment as defined by the Alcoholic Beverage Control. <br /> <br /> 7. That there be no gaming devices, such as pool tables, <br />pinball machines, motion picture booths, etc. <br /> <br /> 8. That interior lighting of the establishment be in ac- <br />cordance with A.B.C. regulations. <br /> <br /> 9. That there be no conduct or entertainment allowed on <br />the premises as prohibited by Ordinance NS-1047. <br /> <br /> 10. That a screening plan for mechanical equipment or ap- <br />purtenances be submitted to and approved by the Planning Depart- <br />ment. <br /> <br />11. That all conditions of the Fire Department be met. <br /> <br />Prior to the Issuance of a Building Permit applicant must: <br /> <br /> 1. Submit to the Department of Public Works, for their <br />approval, an acceptable final grading plan or an on-site drain- <br />age plan, or both, showing the direction and means of flow to <br />the adjacent street(s) or channel(s) when this property is de- <br />veloped. Plan is to include existing and proposed elevations <br />at the property lines. Applicants should check with the Depart- <br />ment of Public Works for extent of study needs. <br /> <br /> <br />
