The Environmental Impact <br />Evaluator shall determine first, whether any given <br />proposal constitutes a "project" as defined in these <br />rules and regulations. <br /> <br /> (a) Emergency Pro~ect Exception: The following emer- <br /> gency projects are exempt from the requirements <br /> for environmental impact reports: <br /> <br /> (1) Projects undertaken, carried out, or <br /> <br /> approved by the Cit~.~f"Santa Ana to main- <br /> tain, repair', restore, demolish or replace <br /> property or facilities damaged or destroyed <br /> as a result of a disaster in a disaster- <br /> stricken area in which a State of emergency <br /> has been proclaimed by the Governor pursuant <br /> to Chapter 7 (commencing with SeCtion .8550) <br /> of Division 1, Title'2 of the Government Code. <br /> <br /> (2) Emergency repairs to public service facilities <br /> necessary to maintain service. <br /> <br /> (3) Projects undertaken as immediate action <br /> .necessary to prevent or mitigate an emergency. <br /> <br />Determination of Ministerial or Discretionary.
