REL:nr <br />4-15-75 <br /> <br />RESOLUTION NO. 75-46 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AUTHORIZING ESTABLISHMENT OF A <br />SELF-INSURANCE PROGRAM <br /> <br /> WHEREAS, the City Council of the City of <br />termined it to be in the interest of the City <br />and officers to provide workers' compensation <br />partial self-insurance program; <br /> <br />Santa Ana has de- <br />and its employees <br />benefits under a <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Santa Ana as follows: <br /> <br />Effective July l, 1975, the City of Santa Ana shall <br />be self-insured for the purpose of providing to all <br />of its officers, employees and their dependents, workers <br />compensation benefits required to be paid under appli- <br />cable provisions of the Labor Code of the State of <br />California and the Municipal Code of the City of Santa <br />Ana. <br /> <br />The City Manager is hereby authorized and directed to <br />take all actions necessary to implement and carry out <br />a self-insurance program including, but not limited <br />to, the payment of benefits and expenses of the Workers' <br />Compensation self-insurance program, administration <br />of claims, legal services and medical treatment. All <br />said actions of the City Manager or his designee shall <br />be in accord with applicable State law, the Municipal <br />Code of the City of Santa Ana and the Charter of the <br />City of Santa Ana. <br /> <br />A Workers' Compensation trust fund shall be established <br />and managed by the City Director of Finance. <br /> <br />The Workers' Compensation trust fund shall be initially <br />funded as approved by the City Council. Additional <br />transfers to said fund shall be made in accordance <br />with the annual budget of the City or on special appro- <br />val of the City Council. The funds of said trust shall <br />be used for payment of benefits and expenses related to <br />the Workers' Compensation Insurance Program established <br />by this resolution and for no other purpose. <br /> <br /> BE IT FURTHER RESOLVED: That employee use of sick leave <br />benefits for industrial absence not be permitted to extend indus- <br />trial leave of absence benefits provided by State law. <br /> <br /> PASSED AND ADOPTED by the City Council <br />Ana at its regular meeting held <br />of April , 1975. <br /> <br />ATTEST: <br /> <br />of the City of Santa <br />on the 21st day <br /> <br />~CLERK OF THE COUNCIL <br /> <br /> <br />
