Recorded August 12, <br />12:05 p.m. <br />Book 11848 <br />Page ]630 <br /> <br />1976 <br /> <br />RESOLUTION NO. 76-86 <br /> <br />REL:adg <br />7/21/76 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA MODIFYING THE ACTION OF <br />THE PLANNING COMMISSION ON VARIANCE APPLICA- <br />TION NO. 76-8, AND GRANTING LIMITED APPROVAL <br />TO SAID VARIANCE APPLICATION AND TO APPEAL <br />NO. 364 FILED THEREON BY LOIS E. MINER <br /> <br /> WHEREAS, a public hearing was duly held before the City <br />Council of the City of Santa Ana on June 7, 1976, on Appeal No. <br />364 filed by Lois E. Miner in opposition to the Planning Com- <br />mission's denial of Variance Application No. 76-8, pertaining to <br />that certain parcel of real property specifically described as <br />follows: <br /> <br />Lot 24, Block B, Tract 506 as shown by a <br />map in Book 17, pages 26-27, Miscellaneous <br />Maps, Records of Orange County, California. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA: that based on such public hearing and the <br />oral and documentary evidence submitted therein, the City Council <br />of the City of Santa Ana does hereby grant the variance requested <br />by Variance Application No. 76-8, for such time only until the <br />said parcel may be sold for valuable consideration, and to the <br />extent necessary to effectuate such limited grant of said variance, <br />does hereby approve Appeal No. 364, approve Variance Application <br />No. 76-8, and modify the decision of the Planning Commission there- <br />on accordingly. <br /> <br /> BE IT FURTHER RESOLVED, that the grant of the said vari- <br />ance for the duration of ownership by the said applicant is found <br />to be appropriate to avoid undue hardship to the said applicant, <br />and that, except as thus modified, the City Council hereby adopts <br />as its findings of fact and conditions those "Finding of Fact, <br />Variance Application 76-8" prepared and submitted by the Planning <br />Commission, attached hereto and incorporated herein as though <br />fully set forth. <br /> <br /> BE IT FURTHER RESOLVED, that the Director of Planning is <br />directed to cause the recordation of this resolution, as appro- <br />priate to give notice to subsequent grantees of the subject- <br />property of the termination of the variance granted herein. <br /> <br /> ADOPTED this <br />following vote: <br /> <br />2nd day of August <br /> <br />,1976, by the <br /> <br />AYES: COUNCILMEN: Bricken, 0rtiz, Yamamoto, Garthe <br /> <br /> NOES: COUNCILMEN: None <br /> <br /> ABSENT: COUNCILMEN: Evans~//B/r andt, Wa r~t--~ <br /> <br /> MAYOR <br /> <br />CLERK OF THE COUNCIL <br /> <br />APPROVED AS TO FORM: <br /> <br />KEITH L.
