REL :nr <br />8-19-76 <br /> <br />RESOLUTION NO. 76- 104 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA AlgA MODIFYING THE ACTION OF THE PLAN- <br />NING COMMISSION ON CONDITIONAL USE PERMIT APPLI- <br />CATION NO. 76-16, APPROVING SAID CONDITIONAL USE <br />PERMIT APPLICATION, AND APPROVING APPEAL NO. 367 <br />FILED THEREON BY CALVARY CHAPEL OF COSTA MESA <br /> <br /> WHEREAS, a public hearing was duly held before the City <br />Council of the City of Santa Ana on August 16, 1976, on Appeal <br />No. 367 filed by Calvary Chapel of Costa Mesa in opposition to a <br />certain condition imposed by the Planning Coramission upon its <br />approval of Conditional Use Permit Application No. 76-16; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, that based on such pub- <br />lic hearing and the oral and documentary evidence submitted there- <br />in, the City Council of the City of Santa Ana does hereby approve <br />said Appeal No. 367, approve Conditional Use Permit Application <br />subject to conditions as hereafter set forth, and modify the action <br />of the Planning Commission thereon by revising the condition imposed <br />by the Planning Commission. <br /> <br /> BE IT FURTHER RESOLVED, that the City Council hereby adopts <br />as its findings of fact for approval of Conditional Use Permit Appli- <br />cation NO. 76-16 that "Finding of Fact, Conditional Use Permit No. <br />76-16" prepared and submitted by the Planning Commission, attached <br />hereto, except that section 6A(4) thereof is revised to read as <br />follows: "That those areas adjacent to MacArthur Boulevard, which <br />are shown as possible future parking or building sites, be land- <br />scaped and maintained as lawn areas." <br /> <br /> BE IT FURTHER RESOLVED that said Conditional Use Permit <br />Application is approved on condition of compliance with all require- <br />ments set forth in the above-said findings as revised and on the <br />additional condition that this conditional use permit shall be <br />submitted for review by this Council at the expiration of twelve <br />months hereafter, at which time this Council may supplement or <br />modify the conditions of approval or initiate revocation proceed- <br />ings for noncompliance with such conditions. <br /> <br /> ADOPTED, this 24th day of August , 1976, <br />by the following vote: <br /> <br />AYES: COUNCILMEN: Brandt, Ward, Bricken, Yamamoto <br /> <br />NOES: COUNCILMEN: None <br /> <br /> ABSENT: COUNCILMEN: 0rtiz, Garthe <br /> ABSTAINED: COUNCILMEN: Evans <br />ATTEST: <br /> <br /> /I ' <br />~ OF THE Co,cmL %~ N <br /> <br />APPROVED AS TO FORM: <br /> <br /> ITH L. -GOW <br />CITY ATTORNEY <br /> <br /> <br />
