.The Agency shall approve or disapprove the plans, draw- <br />ings and related document's referred to in paragraphs (b) and <br />(c) of this Section within the times established in the Sch- <br />edule of Performance. Failure by tile Agency to either ap- <br />prove or disapprove within the times established in the <br />Schedule of Performance shall be deemed an approval. Any <br />disapproval shall state in writing the reasons for disapproval. <br />The Redeveloper, upon receipt of a disapproval based upon <br />powers reserved by the Agency hereunder shall revise such <br />portions as are not a logical evolution of the specific plans <br />and construction requirements previously approved by the <br />Agency and resubmit to the Agency as soon as possible after <br />receipt of the notice of disapproval. All plans, drawings <br />and related documents approved in writing bylthe Agency shall <br />not be subject to subseguent disapproval. <br /> <br />(e) Architect's Certification. The Redeveloper shall <br />submit tO ~iUD~--~ency and the Authority the Architect's <br />Certification on IIUD's prescribed form. Such certification <br />shall be made'by the architect responsible for the prepara- <br />tion of the working drawings and specifications for the Phase <br />I improvements. The Architect's Certificakion shall state <br />that, to the best of the Architect's knowledge belief'and <br />professional judgment, (i) the working drawings and specifi- <br />cations are consistent with the approved final proposal, <br />'and (ii) the proposed construction in accordance with. these <br />plans and specifications is permissible under applicable <br />zoning, building, housing and other Codes,'ordinances, or <br />regulations as modified by any waivers obtained for the ap- <br />propriate officials of the City of Santa Aha. This Certifi- <br />cation shall also cover compliance with the appropriate <br />Minimum Property Standards'(MPS) and other standards, guide- <br />lines and criteria applicable pursuant'to HUD regulations <br />as to Certification and standards issued pursuant to the <br />National llousing Act of 1937. One copy of such certified' <br />working drawings and Specifications shall be submitted with <br />the Architect's Certification to ltUD as well as to.the <br /> Agency and the Authority; provided, however, that receipt <br /> and retention 6y HUD of these working drawings and specifi- <br /> cations shall not denote or constitute HuD review or ap- <br /> proval of such drawings and specifications. <br /> <br /> (e) SEC. 302 Changes in'Cons~ructio~ Plans. This Section <br />is deleted in its ~n~i~ty and a new' S'~on 302 'is inserted as <br />follows: .. <br /> <br /> SEC. 302 Changes in Construction Plans. If the <br /> Redev61oper desires to ma~ any c--~--~e construc- <br /> tion plans after their approval by the Agency, the Re- <br /> developer shal.1 submit the proposed change to the Agency <br /> for its approval. If the construction plans, as mod- <br /> ified by the proposed change conform to the requirements <br /> of Section 301 hereof and the Scope of DeVelopment, the <br /> Agency shall approve the proposed change and notify the <br /> Redeveloper in w~iting within fifteen (15). days after <br /> receiot thereof~b¥ the Aqency, Such chan~e in con- <br /> <br />-27- <br /> <br />FEB, <br /> <br /> <br />
