DF:nr <br />11-1-77 <br /> <br />RESOLUTION NO. 77-125 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA CONSENTING TO THE <br />TRANSFER OF TERRITORY LOCATED GENERALLY <br />NORTH OF EDINGER AVENUE EAST OF THE NEW- <br />PORT FREEWAY FROM THE CORPORATE CITY LIMITS <br />OF THE CITY OF SANTA ANA TO THE CITY OF <br />TUSTIN <br /> <br /> WHEREAS, Mutual Liquid Gas and Equipment Company, <br />a California Corporation, hereinafter referred to as "Company," <br />is the owner of record of that certain real property fronting <br />on the north side of Edinger Avenue immediately east of the <br />Newport Freeway and identified as Assessor's Parcel Number <br />402-101-29, which real property lies within the corporate <br />limits of the City of Santa Ana; and <br /> <br /> WHEREAS, said real property consists of approxi- <br />mately one-third (1/3) acre and is part of 48,243 square <br />feet used by Company in the operation of its business at <br />that location, the remainder of which lies within the City <br />of Tustin and is identified as Assessor's Parcel Number 402- <br />101-28; and <br /> <br /> WHEREAS, the subject real property which lies <br />within the City of Santa Ana is separated from other portions <br />of the City of Santa Ana by the Newport Freeway, and lies <br />within the sphere of influence of the City of Tustin, as <br />determined by the Local Agency Formation Commission of the <br />County of orange; and <br /> <br /> WHEREAS, fire and police service from the City of <br />Santa Ana are not readily available to occupiers of said real <br />property in the City of Santa Aha; and <br /> <br /> WHEREAS, the assessed valuation of the parcel <br />which lies within the corporate limits of the City of Santa <br />Ana is $6,310, which presently generates property tax revenue <br />to the City of Santa Ana of $90.86 annually, and <br /> <br /> WHEREAS, Title 4, Division 2, Article 4.5 of the <br />Government Code of the State of California (Section 35270 et <br />seq.) provides for the transfer of territory from one city <br />to a contiguous city in the same county, which Article re- <br />quires a resolution of consent to the transfer adopted by <br />the legislative body of the city in which the territory is <br />situated to be filed with the board of supervisors of the <br />county in which the two cities are situated along with a <br />resolution of consent to the transfer adopted by the legisla- <br />tive body of the city to which it is proposed to transfer <br />the territory. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council <br />of the City of Santa Ana: that said Council hereby consents <br />to the transfer to the City of Tustin of so much of that <br />certain real property as lies within the City of Santa Ana, <br />which said real property is more fully described as: <br /> <br />That portion of the land allotted to Frederick <br />W. Koll, as described in the Final Decree of <br />Partition of the Rancho Santiago de Santa Aha, <br />which was entered September 12, 1868 in Book <br />"B", page 410 of Judgments of the District <br />Court of the 17th Judicial District in and for <br />Los Angeles County, California, and that por <br />tion of the Westerly half of Tustin Avenue, <br /> <br /> <br />
