DF: nr <br />2-15-78 <br /> <br />RESOLUTION NO. 78-22 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA APPROVING THE SALE OF REAL <br />PROPERTY AT THE NORT~WEST CORNER OF GLENWOOD <br />PLACE AND FLOWER STREET TO THE COMMUNITY RE- <br />DEVELOPMENT AGENCY OF THE CITY OF SANTA ANA <br /> <br /> WHEREAS, Section 2-709 of the Santa Ana Municipal Code <br />("SAMC") excepts the sale of real property by the City of Santa <br />Ana from the requirement of disposition by competitive bidding <br />or public auction, when said sale is made to another governmental <br />agency; and <br /> <br /> WHEREAS, Community Redevelopment Law of the State of <br />dalifornia, Section 33000 et seq. of the California Health and <br />Safety Code, permits any public body, upon the terms and with or <br />without consideration as it determines, to dedicate, sell, convey, <br />or lease any of its property to a redevelopment agency under <br />Section 33220(a) thereof; and <br /> <br /> WHEREAS, the City of Santa Ana desires to sell certain <br />real property to the Community Redevelopment Agency of the City <br />of Santa Aha for the purpose of providing lots outside the redevelop- <br />ment project area on which to move suitable surplus dwelling struc- <br />tures to be rehabilitated under the Housing Replacement Program; <br />and <br /> <br /> WHEREAS, said Program has been designed to assist low- <br />income families displaced from the 14-acre clearance site of the <br />redevelopment project area in purchasing residences outside said <br />project area; and <br /> <br /> WHEREAS, Section 33334.2 of the Health and Safety Code <br />of the State of California provides in pertinent part that a com- <br />munity redevelopment agency may use its funds outside the pro- <br />ject area upon a resolution of the agency and the legislative <br />body that such use will be of benefit to the project; and <br /> <br /> WHEREAS, the City Council of the City of Santa Aha finds <br />that the sale of said real property to the Community Redevelop- <br />ment Agency of the City of Santa Ana will be of benefit to the <br />project in that it will assist families displaced from the project <br />to be relocated outside the project area; and <br /> <br /> WHEREAS, SAMC Sections 27-20 and 27-21 require that, be- <br />fore the disposal of any public real property in the area to <br />which the master plan applies, a finding be made by the Planning <br />Commission of the City of Santa Ana that the location, purpose <br />and extent of said real property complies with the applicable <br />portion of the adopted master plan; which said finding was made <br />by the Planning Commission of the City of Santa Ana on December <br />13, 1977, and communicated by letter to the City Council of the <br />City of Santa Ana on December 14, 1977. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of <br />the City of Santa Ana: <br /> <br /> <br />
