EJC:ar 3/3/81 RESOLUTION NO. 81-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA FIXING AND ESTABLISHING THE COMPENSATION FOR THE OFFICE OF CITY ATTORNEY OF THE CITY OF SANTA ANA, AND REPEALING RESOLUTIONS INCONSISTENT THEREWITH BE IT RESOLVED by the City Council of the City of Santa Ana: 1. That the salary for the office of the City Attorney of the City of Santa Ana is hereby fixed and established at Four Thousand Seven Hundred Forty Dollars ($4,740.00) per month. 2. That said salary shall be paid in the same manner and at the same time as other monthly salaries in the city are paid, and shall take effect and be paid from and after May1 , 1981. 3. That the city shall pay to the Public Employees' Retirement System on behalf of the City Attorney an amount equal to five percent (5.0%) of the compensation upon which the retirement contributions are calculated. Payment there- of is not an increase in base salary. 4. In addition to the salary hereinabove fixed and established for said office, said officer shall receive, as additional compensation, the following employee benefits: (a) Deferred Compensation Said officer shall receive as deferred com- pensation an amount equal to one percent (1%) of his or her monthly salary. The amounts contributed by the city under this provision shall be subject to the terms and conditions of the City of Santa Ana Deferred Compensation Plan, and subject further to the conditions that: · . Said officer shall not have any vested right in the amounts contributed by the city until termination of employ- ment with city; ii. City will pay the total amount of contributions plus any earnings thereon to said officer upon termination, resigna- tion, retirement, dismissal or death.
