RESOLUTION NO. 82-48 <br />PAGE TWO <br /> <br /> (e) The strict application of the zoning <br />ordinance's restrictions on height and construction <br />of signs within the vicinity of a freeway would <br />deprive the subject property of privileges not <br />otherwise at variance with the intent and purpose <br />of the said ordinance, due to the special <br />circumstances of the subject property's location <br />and surroundings. <br /> <br /> (f) The approval of the subject variance is <br />necessary to preserve the right of the owner of <br />the subject property to preserve and enjoy a <br />substantial property right. <br /> <br /> (g) The negative declaration prepared for <br />this project, with its finding that the project <br />will not have a significant effect on the environ- <br />ment, is hereby approved. <br /> <br /> 2. Conditional Use Permit 81-25 and Variance 81-36 <br />are hereby approved, subject to the following limitations, <br />requirements, and conditions: <br /> <br /> (a) The said Conditional Use Permit and <br />Variance shall terminate five (5) years from and <br />after the date of this resolution, unless extended <br />for an additional period, not to exceed five (5) <br />years, by this City Council upon its determination <br />that the findings justifying this approval continue <br />to apply. <br /> <br /> (b) By accepting the benefits of the sign <br />installation hereby authorized, the owner of the <br />subject property consents and agrees that, <br />in the event the said sign is not removed within <br />sixty (60) days of termination of the said Con- <br />ditional Use Permit and Variance, the agents or <br />employees of the City of Santa Ana may enter <br />upon the subject property and remove the said <br />sign, and the said owner shall reimburse the City <br />of Santa Ana for the costs thereby incurred. <br /> <br /> (c) The sign shall be located in accordance <br />with the plot plan submitted to this Council at <br />the abovesaid hearing, except for minor modifications <br />approved by the Planning Department. <br /> <br /> <br />
