<br />This being the date set for hearing on the annexation of property consisting of
<br />approx~tel~ .4 acre~ located at the northwest corner of Seventeenth and Deodar
<br />Streets; no protests were received and the hearing was closed. On motion of Coun-
<br />cilman Gomld, seconded by Hubbard and carried, the following Ordiaance entitled:

<br />was introduced, considered and placed on file for second reading.

<br />Appeal ApplicatiOn No. 9 of Jesse and Lillian OJeda was presented on Variance Appl~
<br />cation No. 1425, wherein Planning Commaission stated it is of the opinion that the
<br />matter is of such magnitude as to be c~ special interest to the people of the City
<br />and requested a hearing before the Council, to erect a six-story (54,foot) apart-
<br />ment house with a six-foot projection into .the required front yard, on property at
<br />1321-1329 Spurgeon Street, in the R-3 District. Communications were presented frc~
<br />Mr. and Mrs. Ernest Ellestad, owners of the first property on the north of the
<br />proposed apartment building, explaining how it concerns neighboring properties and
<br />what effect the proceedings will have on future considerations; from Frank F. LoftJ
<br />property owner within the 300-foot radius of the OJeda property~ favoring the con-
<br />struction of the apartment house. On motion of Councilman G6uld, seconded by Hein~
<br />
<br />and carried, the communications were received and filed. Ernest Wm. Gommel, llOB

<br />West Chapman Avenue,/r~p~esenting Mr. and Mrs. Ellestad, stated the proposed proJe¢

<br />will have a six-foot encroachment into a 20-foot front yard setback, no five-foot
<br />wall setback, and the residents within the SOO-foot radius are concerned about the
<br />850 square feet per dwelling units, in an R-3 District, where the Zoning Ordinance
<br />requires 1200 square feet per dwelling, and also questioned the car parking area
<br />in the basement and rear of the property. Mr. G~el asked clarification regardin~
<br />this area's future change, and the minimum requirements for a dwelling unit, point-
<br />ing out that other neighborhood owners were required to keep the 20-foot front
<br />
<br />setback and purchase additional land for parking facilities to get the required se~
<br /> and his inquiries were satis~actorily answered by the Manager.

<br />out of character to have such a tall building, and the additional necessary parkin~

<br />the encroachment would be at the corner point only and the apartment house is de-
<br />signed to admit maxt--~, light and air, and the entire property has subterranean
<br />parking with 9 by 20-foot spaces for 33 cars, two ramps, and an elevator service
<br />originating in the basement. The Council having unanimously waived the reading of
<br />the Resolution, on motion of Councilman Gould, seconded by Heinly and carried, the
<br />following Resolution entitled:

<br />Appeal Application No. 9 of Foodmaker Company was again presented on Variance Appl~
<br />cation No. 1401, where Planning Commission recommended denial, to erect an adver-
<br />tising sign 47 feet above ground level, which is 12 feet above the height limita-
