REL:adg <br />11/18/82 <br /> <br />RESOLUTION NO. 82- 156 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA APPROVING <br />VARIANCE NO. 82-10 TO MODIFY THE SIDE <br />AND REAR YARD SETBACK REQUIREMENTS FOR <br />PROPERTY LOCATED AT 1719 WEST <br />EDINGER AVENUE IN THE A1 DISTRICT <br /> <br /> WHEREAS, this Council held a public hearing on <br />September 20, 1982, on Variance Application No. 82-10, which <br />application sought to allow 49-foot high athletic field <br />lights as accessory structures at variance with the height <br />and yard setback requirements of the A1 (General <br />Agricultural) use district on property located at 1710 West <br />Edinger Avenue and shown on the map attached hereto as <br />Exhibit A, and incorporated herein by reference; and <br /> <br /> WHEREAS, prior to taking action on the said <br />application, this council has reviewed the negative <br />declaration (I.S. No.82-69) prepared for the project; <br /> <br />NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid <br />hearing this Council finds and determines as follows: <br /> <br /> (a) The strict application of the side and rear <br />yard setback requirements of the A1 district would deprive <br />the subject property of privileges not otherwise at variance <br />with the intent and purpose of said zoning requirements, <br />since, due to the conditions imposed hereinbelow, the <br />reduction of the rear yard setback from 25 feet to 15 feet <br />and the reduction of the side yard setback from 6 feet to 18 <br />inches will not adversely impact neighboring property. <br /> <br /> (b) There are no special circumstances applicable <br />to the subject property justifying waiver of the height <br />requirements of the A1 District. <br /> <br /> (c) The modification of the side and rear yard <br />setback requirements is necessary to allow reasonable <br />evening use of the athletic field on the subject property. <br /> <br /> (d) Due to the conditions imposed hereinbelow, a <br />variance from the side and rear yard setback requirements <br />will not be materially detrimental to the public welfare or <br /> <br /> <br />
