REL:ar
4/6/84

RESOLUTION NO. 84-48

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA ANA APPROVING VARIANCE NO. 83-14 TO
PERMIT SIX EXISTING DETACHED SINGLE-FAMILY
DWELLINGS TO BE USED EXCLUSIVELY TO OPERATE
AN ALCOHOLIC REHABILITATION CENTER AT
401-421 NORTH COOPER STREET IN THE R1 DISTRICT

WHEREAS, this Council held a public hearing on
April 2, 1984, on Variance Application No. 83-14, which
application sought to allow six existing detached single-
family dwellings to be used exclusively to operate an
alcoholic rehabilitation center at variance with the use
restrictions of the R1 (Single-family Residence) district
and off-street parking requirements on property located at
401 through 421 North Cooper Street and shown on the map
attached hereto as Exhibit A and incorporated herein by
reference; and

WHEREAS, prior to taking action on the said
application, this Council reviewed the negative declaration
(I.S. No. 83-151) prepared for the project;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF SANTA ANA AS FOLLOWS:

1. Based on the evidence submitted at the above-
said hearing the Council finds and determines as follows:

(a) The strict application of the use re-
strictions of the R1 district would deprive the subject
property of privileges not otherwise at variance with the
intent and purpose of said zoning requirements, since, due
to the special circumstances of the location and surround-
ings of the subject property, its use as an alcoholic re-
habilitation center having a residential character and
appearance will not adversely affect surrounding residential
property.

(b) The variance from the use restrictions
of the RI district is necessary for the preservation and
enjoyment of the right of the owners and occupants of the
subject property to use the subject property in a manner
