REL:ar <br />4/6/84 <br /> <br />RESOLUTION NO. 84-48 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SANTA ANA APPROVING VARIANCE NO. 83-14 TO <br /> PERMIT SIX EXISTING DETACHED SINGLE-FAMILY <br /> DWELLINGS TO BE USED EXCLUSIVELY TO OPERATE <br />AN ALCOHOLIC REHABILITATION CENTER AT <br />401-421 NORTH COOPER STREET IN THE R1 DISTRICT <br /> <br /> WHEREAS, this Council held a public hearing on <br /> April 2, 1984, on Variance Application No. 83-14, which <br /> application sought to allow six existing detached single- <br /> family dwellings to be used exclusively to operate an <br /> alcoholic rehabilitation center at variance with the use <br /> restrictions of the R1 (Single-family Residence) district <br /> and off-street parking requirements on property located at <br />401 through 421 North Cooper Street and shown on the map <br /> attached hereto as Exhibit A and incorporated herein by <br /> reference; and <br /> <br /> WHEREAS, prior to taking action on the said <br />application, this Council reviewed the negative declaration <br />(I.S. No. 83-151) prepared for the project; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the above- <br />said hearing the Council finds and determines as follows: <br /> <br /> (a) The strict application of the use re- <br />strictions of the R1 district would deprive the subject <br />property of privileges not otherwise at variance with the <br />intent and purpose of said zoning requirements, since, due <br />to the special circumstances of the location and surround- <br />ings of the subject property, its use as an alcoholic re- <br />habilitation center having a residential character and <br />appearance will not adversely affect surrounding residential <br />property. <br /> <br /> (b) The variance from the use restrictions <br />of the RI district is necessary for the preservation and <br />enjoyment of the right of the owners and occupants of the <br />subject property to use the subject property in a manner <br /> <br /> <br />
