REL:adg/a <br />5/28/85 <br /> <br />RESOLUTION NO. 85-74 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SANTA ANA APPROVING VARIANCE <br /> APPLICATION NO. 85-3 TO PERMIT FOOD PROCESSING <br /> AND WHOLESALING, TO WAIVE A PORTION OF THE <br />REQUIRED PARKING, TO PROVIDE A NON-INTEGRATED <br />PARKING DESIGN, AND TO REDUCE REQUIRED SIDE YARDS <br /> ON PROPERTY LOCATED AT 838 EAST FIRST STREET <br /> IN THE C2 AND P DISTRICTS <br /> <br /> WHEREAS, this Council held a public hearing on May 20, <br />1985, on Variance Application No. 85-3, which application sought to <br />allow food processing and wholesaling, to waive a portion of the <br />required parking, to provide a non-integrated parking design, and to <br />reduce required side yards on property located at 838 East First <br />Street in the C2 and P districts, and shown on the map attached <br />hereto as Exhibit A and incorporated herein by reference; and <br /> <br /> WHEREAS, prior to taking action on the said application, <br />this Council has reviewed the negative declaration prepared for <br />the project; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based on the evidence submitted at the abovesaid hear- <br />ing, this Council finds and determines as follows: <br /> <br /> (a) Properties to the northeast and southeast of the <br />subject property are developed with a mixture of heavy and light <br />industrial uses. The strict application of the zoning ordinance <br />would deprive the subject property of the privilege of development <br />and use in a manner compatible with surrounding uses. <br /> <br /> (b) Modification of parking and side yard requirements <br />is necessary to allow development of the subject property in the <br />manner proposed. <br /> <br /> (c) The granting of this variance is necessary to <br />preserve the right of the owner of the subject property to use <br />such property in a manner compatible with surrounding uses. <br /> <br /> (d) This variance is subject to conditions which will <br />protect nearby residential areas from potential adverse effects. <br />The attractive buildinG design will provide a visual upgrading <br />to the area. Therefore the granting of the variance will not be <br />detrimental to the public welfare or to surrounding property. <br /> <br /> <br />
