· BY: ORD/RE O <br /> <br /> ? - - 8'7 <br /> <br />RESOLUTION NO. 88-50 <br /> <br />REL :mb(14) <br />6/15/88 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA SETTING SEWER CONNEC- <br />TION FEES <br /> <br /> WHEREAS, section 39-53 of the Santa Ana Municipal <br />Code ("SAMC") requires payment of a fee for sewer connections <br />to pay for the cost of sewer construction; and <br /> <br /> WHEREAS, said SAMC section 39-53 provides that the <br />amount of the fee is based on an assessment per fixture units, <br />except that in the case of parcels not previously connected to <br />a public sewer the fee for the first occupancy unit benefitted <br />by the sewer connection is based upon the standard cost of <br />construction of a sewer main for a distance equal to the lineal <br />street frontage of the subject parcel; and <br /> <br /> WHEREAS, in accordance with SAMC section 39-53, the <br />assessment per fixture unit and the standard cost of sewer <br />construction per lineal foot of street frontage is to be speci- <br />fied by resolution of the City Council; and <br /> <br /> WHEREAS, the City Council does now find it necessary <br />to increase the sewer connection fee; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. For purposes of SAMC section 39-53, the assess- <br />ment per fixture unit is set at $26.00 and the standard cost <br />of construction of a main sewer line is set at $42.00 per lineal <br />foot. <br /> <br /> 2. The purpose of the fee is to provide for sewers <br />to meet the sanitation needs of the owners and occupants of <br />property in the City. <br /> <br /> 3. The use to which the abovesaid Fee will be put <br />is the construction, or reimbursement for construction, of <br />sewers. The public facilities to be financed by the Fee are <br />identified in Exhibit A, attached hereto and incorporated herein. <br /> <br /> 4. The fee applies to all types of development pro- <br />jects, including residential, commercial, office and industrial, <br />which require connection to the public sewer system. The use <br />of the fee for sewers and the need for such facilities is <br />reasonably related to all types of development projects because <br />all such development projects generate sewage and require the <br />protection from sewage provided by sewers. <br /> <br /> 5. As used hereinafter "project" means proposed <br />construction activity which is subject to the payment of a <br />sewer connection fee under SAMC sections 34-191 through 34-195 <br />and as to which construction pursuant to a validly issued <br /> <br />335 <br /> <br /> <br />
