229 <br /> <br />RESOLUTION NO. 90-004 <br />PAGE THREE <br /> <br /> 5. Any property which qualifies for development in accor- <br />dance with the General Plan density limitations as they existed <br />immediately prior to this General Plan Amendment pursuant to <br />section 4 hereinabove, shall lose such qualification, and there- <br />after be subject to the General Plan density limitations estab- <br />lished by this General Plan Amendment, in the following circum- <br />stances: <br /> <br /> (a) Where such qualification is based upon approval of a <br />conditional use permit: if such conditional use permit is <br />revoked for good cause or expires due to nonuse. <br /> <br /> (b) Where such qualification is based upon approval of a <br />tentative map: if such tentative map expires without approval <br />of a final map or parcel map. <br /> <br /> (c) Where such qualification is based upon development pro- <br />ject plan ("site plan") approval: if application for a building <br />permit for such development pursuant to Chapter 3 of the Building <br />Code is not filed within one (1) year after the date of this <br />resolution. <br /> <br /> (d) Where such qualification is based upon the filing of <br />an application for a building permit pursuant to Chapter 3 of <br />the Building Code: if such building permit application expires <br />without issuance of the building permit, or, as to any development <br />for which a building permit is issued, if such building permit <br />expires without the commencement of construction pursuant thereto. <br /> <br />ADOPTED this ]6th day of January , 1990. <br /> <br />ATTEST: <br /> <br />J~i~e C.
