RESOLUTION NO. 90-110 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />PROVIDING FOR ADDITIONAL Tt~4PORARY PARTIALLY-PAID MILITARY <br />LFAVE OF ABSENCE FOR CITY EMPLOYEES CALLED TO ACTIVE <br />DUTY WITH THE ARMED FORCES AND CONTINUATION OF BI~NEFITS <br />FOR THEIR DEPENDENTS. <br /> <br />O55 <br /> <br /> WHEREAS, Section 9-144 of the Santa Ana Municipal Code grants <br />fully paid leave of absence and continuation of benefits for employees <br />who are ordered to report to duty for a maximum of 30 days per calendar <br />year; and <br /> <br /> WHERFAS, the normal tour of duty to which a reseryist may be <br />ordered without congressional action is six consecutive months; and <br /> <br /> WHERFAS, a number of employees have been and other employees may <br />be called into active military service in connection with the present <br />crisis in the Middle East; and <br /> <br /> WHEREAS, the City Council of the City of Santa Ana wishes to <br />alleviate financial hardships which employees and their families will <br />experience as a result of being called into active duty. <br /> <br />NOW, TH~FORE, BE IT RESOLVED BY THE CITY OF SANTA ANA: <br /> <br /> 1. In addition to the fully paid military leave provided by <br />Section 9~144 of the City's Municipal Code, each full time officer or <br />employee of the City who has been or is called to active military service <br />with the Armed Forces of the United States in connection with the current <br />crisis in the Middle East shall be entitled to military leave with <br />partial pay for the period of absence on military service in excess of <br />the period covered by said Section 9-144. <br /> <br /> 2. The amount of pay each such employee shall be entitled to <br />receive from the City for said additional period of military leave shall <br />be the difference between the gross pay and allowances actually received <br />by the officer or employee from the United States for such service and <br />the gross wages that said employee would have received from the City of <br />Santa Ana if he or she had not been called to active military duty, <br />subject to all necessary and appropriate deductions and withholdings. <br /> <br /> 3. The City shall also provide continued health and dental <br />benefits to the employees' dependents or, for employees represented by <br />the Santa Ana Police Officer Association (SAPOA), the City shall pay to <br />the SAPOA that portion of the City's current contribution to the SAPOA <br />designated specifically for dependent coverage of health and dental <br />benefits, provided that the dependents were covered for those benefits <br />prior to the employee being called to active duty. <br /> <br /> 4. The City shall not pay any wage or benefit provided for in <br />this resolution until and unless the officer or employee who requests <br />such payment provides satisfactory proof and documentation of eligibility <br />to receive payment in accordance with procedures established by the City <br />Manager. <br /> <br /> <br />
