CALIFORNIA ENVIRONMENTAL QUALITY ACT <br />STATEMENT OF OVERRIDING CONSIDERATIONS <br />FOR THE ORANGE COUNTY REGISTER <br />PRODUCTION FACILITY EXPANSION <br /> <br />The California Environmental Quality Act (CEQA) and the State CEQA Guidelines <br />provide that: <br /> <br />"CEQA requires the decision maker to balance the benefits of a proposed <br />project against its unavoidable adverse risks in determining whether to <br />approve the project. If the benefits of the proposed project outweigh the <br />unavoidable adverse environmental effects, the adverse impacts may be <br />considered acceptable. <br /> <br />Where the decision of the public agency allows the occurrence of <br />significant effects which are identified in the Final Environmental Impact <br />Report (EIR) but are not mitigated, the agency must state in writing the <br />reasons to support its action based on the Final EIR and/or other <br />information in the record. This statement may be necessary if the agency <br />also makes the finding under Section 15091(aX2)or (aX3). <br /> <br />If an agency makes a statement of overriding considerations, the statement <br />should be included in the record of the project approval and should be <br />mentioned in the Notice of Determination." (Section 15093 of the State <br />CEQA Guidelines). <br /> <br />PROPOSED PROJECT <br /> <br />The City of Santa Ana proposes to approve the expansion of the existing Orange County <br />Register newspaper production facility located at 625 North Grand Avenue in the City of <br />Santa Aha. The expansion project will be constructed in two phases~ and will add <br />266,675 square feet to the production facility in Phase I and 31%265 square feet in <br />Phase 11. The project related approvals will include a General Plan Amendment; zone <br />change; amendment to the existing Development Agreement; vesting tentative parcel <br />map and street abandonment. Because these actions constitute a project under CEQA <br />and the Guidelines~ an EIR has been prepared by the City of Santa Ana. <br /> <br />SIGNIFICANT ENVIRONMENTAL IMPACTS OF THE PROJECT THAT CANNOT BE <br />MITIGATED TO A LEVEL OF INSIGNIFICANCE <br /> <br />The project may have significant or certain substantial adverse impacts on the <br />environment which cannot be fully mitigated. These impacts are identified in the Final <br />EIR and in the Statement of Findings and Facts included in the Final EIR. All the <br />impacts associated with the proposed project have been mitigated to the extent <br />considered feasible and have been reduced through the incorporation of all the mitigation <br />measures as Conditions of Approval. The mitigation measures are listed in the <br />Mitigation Monitoring Program report incorporated in the Final EIR. <br /> <br />The significant environmental impacts of the proposed project that cannot be mitigated <br />to a level of significance as identified in the Final EIR and the Statement of Findings and <br />Facts are-' <br /> <br />The removal of 190 apartment units located to the north of the existing Register <br />facility. <br /> <br /> <br />
