ORD/RESO o^'r£.._ RESOLUTION NO. 91- 047 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING SEWER CONNECTION FEES 005 WHEREAS, section 39-53 of the Santa Ana Municipal Code ("SAMC") requires payment of a fee for sewer connections to pay for the cost of sewer construction; and WHEREAS, in accordance with SAMC section 39-53, the assessment per fixture unit and the sewer connection application fees resulting therefrom are to be specified by resolution of the city Council; and WHEREAS, the city Council does now desire to increase the sewer connection fee; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. For purposes of SAMC section 39-53, the assessment per fixture unit is set at $51.00. 2. The purpose of the fee is to provide for sewers to meet the sanitation needs of the owners and occupants of property in the City. 3. The use to which the above said Fee will be put is the construction, or reimbursement for construction, of sewers. The public facilities to be financed by the Fee are identified in Exhibit A, attached hereto and incorporated herein. 4. The fee applies to all types of development projects, including residential, commercial, office and industrial, which require connection to the public sewer system. The use of the fee for sewers and the need for such facilities is reasonably related to all types of development projects because all such development projects generate sewage and require the protection from sewerage provided by sewers. 5. As used hereinafter "project" means proposed construction activity which is subject to the payment of a sewer connection fee under SAMC sections 34-191 through 34-195 and as to which construction pursuant to a validly issued building permit has not commenced as of the date of adoption of this resolution.
