RESOLUTION NO. 92-057 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ESTABLISHING SEWER CONNECTION FEES WHEREAS, section 39-53 of the Santa Ana Municipal Code ("SAMC") requires payment of a fee for sewer connections to pay for the cost of sewer construction; and WHEREAS, in accordance with SAMC section 39-53, the assessment per fixture unit and the sewer connection application fees resulting therefrom are to be specified by resolution of the City Council; and WHEREAS, the City Council does now desire to increase the sewer connection fee; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: 1. The public facilities to be financed by the fee are identified in Exhibit A, attached hereto and incorporated herein. 4. The fee applies to all types of development projects, including residential, commercial, office and industrial, which require connection to the public sewer system. The use of the fee for sewers and the need for such facilities is reasonably related to all types of development projects because all such development projects generate sewage and require the protection from sewerage provided by sewers. 5. As used hereinafter "project" means proposed construction activity which is subject to the payment of a sewer connection fee under SAMC sections 34-191 through 34-195 and as to which construction pursuant to a validly issued building permit has not commenced as of the date of adoption of this resolution. 6. Ail previous resolutions of the city Council establishing or increasing sewer connection fees are superseded by this resolution, and the fees established by this resolution shall apply to all projects, except as otherwise hereinafter provided.
