RESOLUTION NO. 91-095 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA ESTABLISHING CRITERIA <br />FOR CHARITABLE PAYROLL DEDUCTIONS, <br />REPEALING RESOLUTION NO. 79-172, AND <br />AUTHORIZING UNITED WAY OF ORANGE COUNTY <br />NORTH/SOUTH AND THE ENVIRONMENTAL FEDERA- <br />TION OF CALIFORNIA TO CONDUCT CHARITABLE <br />FUND DRIVES AMONG CITY EMPLOYEES. <br /> <br /> WHEREAS, Section 1157.2 of the Government Code provides <br />that "With the approval of the governing body of a public agency <br />and under such regulations a sit may prescribe, employees of the <br />public agency may authorize deductions to be made from their <br />salaries or wages either for the payment of contributions to bona <br />fide charitable organizations or for the payment of designated sums <br />to a nonprofit California corporation which is compelled by its <br />bylaws to make, and which does expend such sums solely by the <br />making of, contributions to bonafide charitable organizations;" and <br /> <br /> WHEREAS, the City of Santa Ana desires to minimize loss <br />of productive work-time from public business by City employees <br />occasioned by charitable fund drives in City facilities; and <br /> <br /> WHEREAS, the City Council of the City of Santa Ana <br />considers a combined fund drive on behalf of charitable <br />organizations to be more efficient and equitable than multiple fund <br />drives and, thus, in the best interests of the City and its <br />employees; and <br /> <br /> WHEREAS, the city Council of the City of Santa Ana <br />considers Section 13923 of the Government Code relating to <br />charitable payroll deductions for state officers and employees to <br />be an appropriate and desirable precedent for application by the <br />city of Santa Ana. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. The City Council hereby approves and provides subject <br />to such regulations as this Council may prescribe that charitable <br />payroll deductions from the salaries or wages of city of Santa Ana <br />employees are available for charitable contributions to that Agency <br />which conducts the principal combined fund drive in the City of <br />Santa Ana, which Agency shall be determined by the City Council <br />based upon the following criteria: <br /> <br />The number of charitable agencies operating within <br />the city of Santa Ana which rely on the drive for <br />their support. <br /> <br /> <br />
