~DG:nr <br />9-26-79 <br /> <br />RESOLUTION NO. 793 72 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA ESTABLISHING CRITERIA <br />FOR CHARIT;%BLE PAYROLL DEDUCTIONS <br /> <br /> WHEREAS, Section 1157.2 of the Government Code <br />provides that "With the approval of the governing body of a <br />public agency and under such regulations as it may prescribe, <br />employees of the public agency may authorize deductions to be <br />made from their salaries or wages either for the payment of <br />contributions to bona fide charitable organizations or for the <br />payment of designated sums to a nonprofit California <br />corporation which is compelled by its bylaws to make, and <br />which does expend such sums solely by the making of, <br />contributions to bona fide charitable organizations;" and <br /> <br /> WHEREAS, the City of Santa Ana desires to minimize <br />loss of productive work-time from public business by City <br />employees occasioned by charitable fund drives in City <br />facilities; and <br /> <br /> WHEREAS, the City Council of the City of Santa Ana <br />considers a single, combined fund drive on behalf of <br />charitable organizations to be more efficient and equitable <br />than multiple fund drives and, thus, in the best interests of <br />the City and its employees; and <br /> <br /> WHEREAS, the City Council of the City of Santa Ana <br />considers Section 13923 of the Government Code relating to <br />charitable payroll deductions for state officers and employees <br />to be an appropriate and desirable precedent for application <br />by the City of Santa Ana. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA AS FOLLOWS: <br /> <br /> The City Council hereby approves and provides, <br />subject to such regulations as this Council may prescribe, <br />that charitable payroll deductions from the salaries or wages <br />of City of Santa Ana employees are available for charitable <br />contributions to that Agency which conducts the principal <br />combined fund drive in the City of Santa Ana, which Agency <br />shall be determined by the City Council based upon the <br />following criteria: <br /> <br />ae <br /> <br />The number of charitable agencies operating <br />within the City of Santa Ana which rely on the <br />drive for their support. <br /> <br />The number of dollars raised in Santa Ana <br />during the last completed fund drive. <br /> <br />The percentage of dollars dispersed to agencies <br />as a result of the fund drive. <br /> <br />The willingness of the combined fund drive to <br />submit its application in the form prescribed <br />by the Council, including an agreement to abide <br />by applicable portions of Section 663, Title 2, <br />Calif. Administrative Code, entitled "Payroll <br />Deductions for Charitable Contributions." <br /> <br /> <br />
