<br />instructions be approved and signed for certain properties and with the following
<br />
<br />persons:

<br /> Supplemental instructions, dated April 6, 1962, to extend the closing
<br />date to on or before May 2, 1962, on Escrow Instructions No. 8639S6-HRB, date¢
<br />January 29, 1962, with Roy J. and Edith May Lyon, for real property on the
<br />southeast comer'of Fifth and Bush Streets, in the sum of $90,000.00,
<br />
<br /> Escrow Instruction No. ~6068-C, dated March 29, 1961, with L~dia Rupp
<br />Kile and Virginia Underwood, for a parcel of real property on the south side
<br />of Eighth Street, east of Garnsey Street, for street and Civic Center purpose~
<br />for the sum of $1B,125.OO for the real property, plus $200.00 for moving ex-
<br />penses, making a total of $13,325.00,
<br />
<br /> Amendment to Escrow Instructions No. 46068-C, dated JU~y 2h, 1961, with
<br />Virginia Underwood and Lydia Rupp Kile, wherein seller is to have 60 days frei
<br />occupancy after close of escrow, without rent; and escrow holder will be fur-
<br />nished prior to close of escrow with a certified copy of the death certificat~
<br />of James D. Kile, and with an affidavit of surviving Joint tenancy, but may
<br />not be furnished with an inheritance tax release. Should the inheritance tax
<br />release not be furnished escrow holder at the time the other two documents ar~
<br />delivered into escrow, then escrow holder is hereby authorized to immediately
<br />proceed toward closing escrow and writing its policy of title insurance which
<br />may show that sa~d Dolicy of title insurance is subject to "any lien for in-
<br />heritance tax .payable to State of California, or for estate tax payable
<br />to United States Government, or both, by reason of the death of James D. Kile
<br />former owner in Joint tenancywith Lydia Rupp Kile and Virginia Underwood,"

<br /> Amendment to Escrow Instructions No. h6068-C, dated September 11, 1961,
<br />with Lydia M. Abernathy, Guardian of the Estate of Lydia Rupp Kile, inc~mme-
<br />tent, and Virginia Underwood, for the reason that Petition for Guardian of
<br />the Estate of Lydia Rupp Kile, incompetent, was filed August 18, 1961, in the
<br />County of Orange, State of California, in the County Clerk's Office as Case
<br />No. A-38872, escrow holder is advised that petition will be filed in re this
<br />guardianship providing for delivery into escrow of a Deed executed by the
<br />guardian and by Virginia Underwood to the City of Santa Aha; which Deed will
<br />be accempanied by a certified copy of Order Confirming Sale which will provid~
<br />for the sale of said property to the City of Santa Aha on the terms set out iz
<br />the original escrow instructions, to-wit: $13,325.00 and for distribution of
<br />net seller's proceeds as follows: One-half to Lydia M. Abernathy, Guardian
<br />of the Estate of Lydia Rupp Kile, incompetent, and one-half to Virginia Under-
<br />wood,

<br /> Amendment to Escrow Instructions No. h6068-C, dated April 10, 1962, with
<br />Lydia M. Abernathy, Guardian of the Estate of Lydia Rupp Kile, incompetent,
<br />and Virginia Underwood, for i~ediate possession of the property being given,
<br />per arrangement made outside of escrow between Sellers and the City of santa
<br />Aha. No pro-rate of taxes is required in this escrow; sellers having paid
<br />total 1961-62 taxes. Sellers have agreed to and do hereby cousent to dismis-
<br />sal of an action in eminent domain filed in the Superior Court of the County
<br />of Orange, State of California, by the City of Santa Ana vs Santa Aha Chamber
<br />of Commerce, et al, S.C.C. ~10301~, covering the property being handled
<br />through this escrow, and do also waive any and all claims to any money that
<br />may be deposited in the Superior Court in re: said action, and
<br />
<br /> Escrow Instructions No. 47552-C, dated March 22, 1962, with Genevieve
<br /> Lowe Martin, for a parcel of real property for street purposes on the north
<br /> side of Brook Street, east of Baker Street, in the sum of $600.00, and the
<br /> construction by the City of curb, gutter, sidewalk, paving, and driveway
<br /> approach.

<br />On motion of Councilman Hubbard, seconded by Brewer and carried, proper officials '
<br />
<br />were authorized to execute lease with Standard Oil C~mpany of California, Western
<br />
<br />Operations, Inc., for property on the southeast corner of Flower and Eighth Street:

<br />The Council having unanimousl~ waived the reading of the Resolution, on motion of
<br />
<br />Councilman Hubbard, seconded by Schlueter and carried, the following Resolution
<br />
<br />entitled:

<br />"Resolution No. 62-78 accept~ deeds where the City is paying
<br />a cash consideration"
<br />
<br />from Virginia Underwood and Lydia M. Abernathy, Guardian of the person and estate
<br />
<br />of Lydia Ruth Kile, an incompetent person, for a parcel of real property on the
<br />
<br />south side of Eighth Street, East of Garnsey Street, for street and Civic Center
<br />
<br />purposes, in the sum of $13,125.OO for the real property, plus $200.O0 for moving
<br />
