107 <br /> <br />RESOLUTION NO. <br /> <br /> REL:mb 1/11/93 <br /> Rev. 2/16/93 <br />93-017 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AUTHORIZING A REWARD FOR INFORMA- <br />TION LEADING TO THE IDENTITY, APPREHENSION AND <br />CONVICTION OF ANY PERSON CAUSING GRAFFITI <br />WITHIN THE CITY OF SANTA ANA. <br /> <br /> WHEREAS, Government Code Section 53069.5 and the City Charter <br />of the City of Santa Ana authorize the City to offer and pay a <br />reward, the amount thereof to be determined by the Council, for <br />information leading to the identity, apprehension and conviction of <br />any person who willfully damages or destroys any property. <br /> <br /> WHEREAS, it is in the public interest and the benefit of the <br />City of Santa Ana that vandals who willfully damage property by <br />inscribing thereon graffiti shall be brought to justice. <br /> <br /> WHEREAS, the inscribing of graffiti on structures and of <br />objects located on public or privately owned real property without <br />the consent or permission of the owner is a public nuisance and <br />obnoxious because such markings result in blight and deterioration <br />of the property with a resulting loss of property values and <br />business values in the community. <br /> <br /> WHEREAS, the purpose of offering rewards is to encourage <br />people to give assistance to the Santa Ana Police Department so <br />that the police department may better protect the City's property <br />and the property of persons within the City by identifying, <br />apprehending and convicting persons responsible for inscribing <br />graffiti within the City of Santa Ana. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. The City Council hereby authorizes a reward of Five <br />Hundred Dollars ($500.00) for information leading to the identity, <br />arrest and conviction of any person whose willful misconduct <br />results in the perpetration of, or aid in, causing graffiti to be <br />inscribed on any structure on publicly owned or privately owned <br />property within the City of Santa Ana. "Graffiti" shall have the <br />meaning as defined in Section 1410.5(1) of the California Evidence <br />Code which provides that graffiti consists of written words, <br />insignia, symbols, or other markings which are placed on structures <br />without the permission of the owner. "Conviction" shall mean the <br />conviction in a court of law of a person charged with the crime of <br />inscribing graffiti on a structure or in the case of a juvenile, <br />the judgment or finding of the Juvenile Court that the juvenile <br />inscribed graffiti on a structure within the City of Santa Ana. <br />The City Council hereby appropriates the sum of Two Thousand Five <br /> <br /> <br />
