F, .~I.L WITI-[ RESPECT <br />TO THE PROPOSED REDEVELOPMENT PLAN AND RELATED ACTIONS <br /> <br />L P~4CKGROUND <br /> <br />The California Environmental Quality Act (CE~4) and the State CEQ. A Guidelines (Guidelines) <br />promulgated pursuant thereto prmgde: <br /> <br />"No public agency shall approve or carry out a project for which an EIR has been completed which <br />identifies one or more significant environmental effects of the project unles~ the public agency makes one <br />or more written findings for each of those significant effects, accomlntnied by a brief e. rplanation of the <br />rationale for each finding.' <br /> <br />The possible findings are: <br /> <br />Changes or alteratioos have been required in, or incorporated into, the project which avoid or <br />substantially le~n the significant environmental effect as identified in the Final F_JR. Hereafter <br />referred to a~ Finding I. <br /> <br />2. <br /> <br />Such changes or alterations are within the r~lnmsibitity and jurisdiction of another public agency <br />and not the agen~ making the finding. Such change~ haw been adopted by such other agency <br />or can and should be adopted by such other agency. Hereafter referred to as Finding Z <br /> <br />Specific economic, socta~ or other cousideratlon$ make infeasible the mitigation measures or <br />project alternativ~ identified in the Final EIR (Section 15091 of the Guidelines). Hereafter <br />referred to as Finding 3. <br /> <br />The City of Santa Ana Community Development Agency is the lead agency involved in the establishment <br />of the Community Faciliti~ Improvement Plan, which ir the project os defined by Section 21065 of the <br />Government Code. In compliance with CE~b4, the Santa Ana Community Development Agency has <br />prepared a Environmental Impact Repor~ (EIR). The F_JR for the project provides a discussion of the <br />environmental setting and evaluates potential environmental impacts of the Plan, as well as the impacts <br />which may occur as result of projects funded under the Plan. Further, the Planning Commission is <br />recommending to the Cay Council determination that the EIR is complete and has been prepared in <br />accordance with CEQA and the CEO./4 Guidelines. Therefore, the following findings are set forth herein <br />pursuant to Section 15091 of the CEQ, A Guidelines. <br /> <br />0 <br />0 <br /> <br />0 <br /> <br />0 <br /> <br />A) EARTHAND GEOLOGY <br /> <br />Potentially Significant Effect: <br /> <br />The terrain within the project area is relatively flat with no major differences in local relief According to <br />past seismic studies conducted in the project area, no known or suspected active fault traces pass through <br />the project area.
