596 <br /> <br />P- HIB1T <br /> <br />P.4GE 10 <br /> <br />STATEMENT OF OVERRIDING CONSIDERATIONS <br /> <br />The California Environmental Quality Act (CEQ.~4) and the State EIR Guidelines promulgated pursuant thereto <br />provide: <br /> <br />CEQ/I requires the decision-maker to balance the benefits of a proposed project against its <br />unavoidable environmental risks in determining whether to approve the pro]ect. Where agencies <br />have taken action resulting in environmental damage without explaining the reasons which <br />supported the decision courts have invalidated the action. <br /> <br />Where the decision of the public agency allows the occurrence of significant bffects which are <br />identified in the final EIR but not mitig~et~ the agency must state in writing the reasons to support <br />its action based on the final EIR and/or other information reconis. This statement may be <br />necessu~y if the agency also mal~s the finding under Section 15091 (a) (2) or (a) (3). <br /> <br />If an agency makes a Statement of Overriding Considerations, the Statement shouM be included <br />in the record of the project approval and shouM be mentioned in the Notices of Determination." <br />(Section 15093 of the Guidelines) <br /> <br />The City of Santa Ana proposes to approve a Redevelopment Plan for the~.~',~e/l~nunity Facilities Improvement <br />Program. Because the action constitutes a project under CEQ~A and~C_~dellt~s, an Environmental Impact <br />nepon (Mn) has been preparea~ The EIR has identified certain~,.~igl~fic~#~4~n~onryntal effects that will follow <br />from this project and the CiO' of Santa Ana desires to ~ this~II~a~tN~er d~ennining that the FEIR is <br />complete and has been prepared in accordance wi~d and~]~#~u'~n-es, and yaking the accompanying <br />Statements of Facts, the CiO, of Santa Ana~al_s_o ~lgh~~ant effects d~ the project against the <br />overriding considerations not*d~~ ~t~X~'~ ~.~ ~ <br /> <br /> 2. The project pr~vides ~dev~g?~t fuK~.~lke~expansion and new construction of parks <br /> and recre~on facih'~es throughout the City. <br /> 3. The plan ~ school distr~ through educa~onal facility financing. <br /> <br /> 4. The projec~hroughout Santa Ana, which will help the City attract <br /> new businesses and retain existing businesses. <br /> <br />The project will substantialty enhance e~dsting overcrowded recreational facilities by providing new <br />playground equipment, tennis courts, soccer and ballfield complexes, new landscaping and building <br /> <br />6. <br /> <br />The project will provide new police administration and detention facilities to enhance the safety <br />of all Santa .,ina residents. <br /> <br /> <br />
