· 07 1 <br /> <br />RESOLUTION NO. 93- 065 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA APPROVING VARIANCE NO. <br />92-008, TO ALLOW A REDUCTION IN MINIMUM <br />LOT SIZE AND A REDUCTION IN LANDSCAPED <br />PLANTER SIZE FOR A PROPOSED COMMERCIAL <br />BUILDING LOCATED AT 2629 WEST WESTMIN- <br />STER AVENUE <br /> <br /> WHEREAS, this Council held a public hearing on July 6, 1993, <br />on Variance Application No. 92-008, to allow a reduction in minimum <br />lot size and a reduction in landscaped planter size for a proposed <br />commercial building located at 2629 West Westminster Avenue; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA AS FOLLOWS: <br /> <br /> 1. Based upon the evidence submitted at the abovesaid hearing <br />this Council finds and determines as follows: <br /> <br />A. Because of special circumstances applicable to the subject <br />property, the strict application of the minimum lot size and <br />minimum planter size requirements in the zoning regulations <br />would deprive the subject property of privileges not otherwise <br />at variance with the intent and purpose of the provisions of <br />this chapter; <br /> <br />As the site is surrounded by residential and commercial <br />uses, it is unlikely that additional land can be acquired <br />to obtain compliance with minimum lot size standards. <br />The small size of the lot makes compliance with planter <br />size standards infeasible. However, side yard setback <br />standards can be maintained by a modest reduction in <br />building size. <br /> <br />B. That the granting of a variance is necessary for the <br />preservation and enjoyment of one or more substantial property <br />rights; <br /> <br />The granting of the variance as to minimum lot size and <br />planter size is necessary to allow development of the <br />site. <br /> <br />C. That the granting of a variance will not be materially <br />detrimental to the public welfare or injurious to surrounding <br />property; <br /> <br />The granting of the variance will allow a beneficial use <br />of the property, will promote the removal of a dilapidat- <br />ed structure now on the property, and will provide for <br /> <br /> <br />
