Based upon the evidence submitted at the abovesaid hearing
this Council finds and determines as follows:

A. Because of special circumstances applicable to the subject
property, the strict application of the minimum lot size and
minimum planter size requirements in the zoning regulations
would deprive the subject property of privileges not otherwise
at variance with the intent and purpose of the provisions of
this chapter;

As the site is surrounded by residential and commercial
uses, it is unlikely that additional land can be acquired
to obtain compliance with minimum lot size standards.
The small size of the lot makes compliance with planter
size standards infeasible. However, side yard setback
standards can be maintained by a modest reduction in
building size.

B. That the granting of a variance is necessary for the
preservation and enjoyment of one or more substantial property
rights;

The granting of the variance as to minimum lot size and
planter size is necessary to allow development of the
site.

C. That the granting of a variance will not be materially
detrimental to the public welfare or injurious to surrounding
property;

The granting of the variance will allow a beneficial use
of the property, will promote the removal of a dilapidat-
ed structure now on the property, and will provide for
